Advokaters skadeståndsansvar vid vårdslös rådgivning – Särskilt om professionsansvar och culpabedömningen

Frågan om professionella rådgivares ansvar vid rådgivning har blivit alltmer uppmärksammad i svensk doktrin och praxis allteftersom rådgivarnas roll har blivit viktigare i samhället. Till denna grupp av rådgivare hör advokater, en yrkeskår som klienter anlitar för dess särskilda juridiska expertis. Det övergripande syftet med denna uppsats är att utreda och diskutera advokaters ansvar för ren förmögenhetsskada som vållas en avtalskontrahent genom vårdslös rådgivning. Arbetet inriktas särskilt på vad professionsansvaret innebär, hur culpabedömningen görs, samt huruvida lagstiftning borde införas avseende advokaters professionsansvar.

Det övergripande syftet med denna uppsats är att utreda och diskutera advokaters ansvar för ren förmögenhetsskada som vållas en avtalskontrahent genom vårdslös rådgivning. Arbetet inriktas särskilt på vad professionsansvaret innebär, hur culpabedömningen görs, samt huruvida lagstiftning borde införas avseende advokaters professionsansvar.

Rådgivare bär ett professionsansvar, vilket innebär ett krav på att uppdrag ska utföras fackmässigt. Advokaters professionsansvar konkretiseras av de väg-ledande reglerna om god advokatsed och avgöranden från advokatsamfundets disciplinnämnd. När en advokat inte uppfyller sitt professionsansvar och detta ger upphov till skada för klienten, kan detta anses utgöra vårdslös rådgivning.

Culpabedömningen avseende advokaters skadeståndsansvar har genom NJA 2018 s. 414 och mål T 2841-18 kommit att konkretiseras av HD. I dessa mål utpekas sex omständigheter att beakta vid culpabedömningen, vilka vid en närmare granskning inte verkar ha förändrat rättsläget nämnvärt. Vidare behandlas frågan om HD:s uppenbarhetsrekvisit vid advokaters skadeståndsansvar och slutsatsen dras att rekvisitet varken förändrat rättsläget, eller innebär ett krav på grov vårdslöshet för att ansvar ska uppstå.

Avslutningsvis diskuteras för- och nackdelar med att införa lagstiftning gällande advokaters professionsansvar. Trots att viss kritik kan framföras mot nuvarande ordning och att det finns vissa pedagogiska fördelar med lagstiftning, dras slutsatsen att en sådan inte bör införas eftersom den inte skulle bli precis nog och snabbt skulle föråldras. The issue of professional liability for professions providing advisory services has received increased attention in Swedish doctrine and case law as professional advisers have gained a more prominent role in society. These advisers include lawyers, a profession that clients turn to specifically for its legal expertise. The overall purpose of this paper is to examine and discuss the professional liability of lawyers when a client suffers pure economic loss due to the lawyer’s advice. In particular, the paper focuses on what their professional responsibility entails, how the liability assessment is made, and whether legislation regarding lawyer’s responsibilities should be introduced.

The issue of professional liability for professions providing advisory services has received increased attention in Swedish doctrine and case law as professional advisers have gained a more prominent role in society. These advisers include lawyers, a profession that clients turn to specifically for its legal expertise. The overall purpose of this paper is to examine and discuss the professional liability of lawyers when a client suffers pure economic loss due to the lawyer’s advice. In particular, the paper focuses on what their professional responsibility entails, how the liability assessment is made, and whether legislation regarding lawyer’s responsibilities should be introduced.

Advisers bear a professional responsibility, and thus they have certain responsibilities which must be performed in accordance with good practices. The obligations of lawyers are defined by the profession’s guiding rules on good practices and decisions of the Swedish Bar Association’s Disciplinary Committee. If a lawyer does not fulfill his professional responsibilities and causes the client economic loss, his professional liability can be triggered.

The assessment of lawyers’ liability was defined in two recent cases of the Supreme Court, NJA 2018 s. 414 and T 2841-18. In these cases, six circumstances were identified as relevant for the assessment, which upon closer scrutiny do not appear to have significantly changed the legal situation. Furthermore, the court’s requirement of the lawyer’s negligence being obvious is discussed and it is concluded that this requirement does not mean a change in the law, or that gross negligence is required for liability to arise.

Finally, the pros and cons of introducing legislation regarding the responsibilities of lawyers are discussed. Although some criticism can be directed towards the legal situation and although there are certain pedagogical benefits of legislation, it is concluded that legislation should not be introduced as it would not be precise enough and would quickly become outdated.
