Förvaltningsdomstolens materiella processledning - en tillfredställande garanti för den enskildes rättsskydd?

När den enskilda överklagar ett förvaltningsbeslut står den ofta som ensam motpart i rätten mot myndighetens processjurister. För att den enskilde ska kunna ta till vara på sin rätt och obalansen inte ska bli oskäligt stor mellan parterna har domaren lagstadgade möjligheter att påverka processen så att den enskildes rätt tas tillvara. Denna uppsatsens syfte är att undersöka om en sådan ordning kan anses vara tillfredställande för den enskildes behov av rättsskydd i domstolsprocessen.

När den enskilda överklagar ett förvaltningsbeslut står den ofta som ensam motpart i rätten mot myndighetens processjurister. För att den enskilde ska kunna ta till vara på sin rätt och obalansen inte ska bli oskäligt stor mellan parterna har domaren lagstadgade möjligheter att påverka processen så att den enskildes rätt tas tillvara. Denna uppsatsens syfte är att undersöka om en sådan ordning kan anses vara tillfredställande för den enskildes behov av rättsskydd i domstolsprocessen.

Frågan har angripits med hjälp av rättsdogmatisk metod för att utröna den praktiska tillämpningen av de relevanta lagrummen. Det framkommer att det är många skilda faktorer som påverkar domarens agerande i rätten. Därefter studeras rättssäkerheten i processordningen med fokus på legalitets- och objektivitetsprincipen och hur dessa principer förhåller sig till domarens regeltillämpning.

Resultatet visar att det inte finns någon given konsensus kring hur och när den materiella processledningen ska tillämpas utan det vilar på den enskilde domaren att avgöra när så är lämpligt. Ur den enskildes rättssäkerhets- perspektiv finns mer att önska av både förvaltningsprocesslagens tydlighet och den intresseövervakning som domaren utövar. Det finns praktiska faktorer som förklarar förvaltningsprocesslagens utformning och förvaltningsrättsliga principer som förklarar domarens intresseövervakning. Den slutsats som nås är att domarens materiella processledning möter behovet av den enskildes rättsskydd på ett tillfredställande sätt. (Less)

When the individual appeals against an official decision, he or she often stands as the sole counterparty in the court against the authority’s litigator. In order for the individual to be able to exercise his or her rights and to even out an unreasonably large imbalance between the parties, the judge has statutory opportunities to influence the process so that the legal rights of the individual is granted. The purpose of this paper is to investigate whether such an arrangement is to be considered satisfactory for the individual's need of legal protection in the court action.

When the individual appeals against an official decision, he or she often stands as the sole counterparty in the court against the authority’s litigator. In order for the individual to be able to exercise his or her rights and to even out an unreasonably large imbalance between the parties, the judge has statutory opportunities to influence the process so that the legal rights of the individual is granted. The purpose of this paper is to investigate whether such an arrangement is to be considered satisfactory for the individual's need of legal protection in the court action.

The thesis has been written using the formal dogmatic approach to find out the practical application of the relevant laws. The investigation shows that there are many different factors that influence the judge's actions in court. Thereafter the legal certainty is studied in the procedural order with a focus on the principles of legality and objectivity and how these principles relate to the judge's application of laws and rulings.

The thesis shows that there is no given consensus on how and when the rules should be applied. It is up to the individual judge to decide when so is appropriate. From the individual’s perspective, there is more to be desired from both the clarity of the administrative court procedure act and the interest monitoring exercised by the judge. There are practical factors that explain the structure of the administrative court procedure act and there are principles of administrative law that explain the judge's interest monitoring. The conclusion reached is that the judge's process management satisfactorily meets the need for the individual's legal protection. (Less)
