Bör medlemskap i terroristorganisationer kriminaliseras? - En redogörelse för terroristmedlemmars föreningsfrihet

Sveriges terrorhotnivå ligger på en fortsatt förhöjd risk enligt Nationellt centrum för terrorhotbedömning (NCT). Terrorism och terroristorganisationer upplevs som ett hot mot samhället och den svenska regeringen vill motverka terrorismen genom att motverka terroristorganisationernas organisationsrätt. Uppsatsen avser att redogöra för föreningsfriheten för terroristmedlemmar i Sverige genom att studera den nuvarande regleringen av föreningsfriheten samt dess begränsningar. Sveriges terrorhotnivå ligger på en fortsatt förhöjd risk enligt Nationellt centrum för terrorhotbedömning (NCT). Terrorism och terroristorganisationer upplevs som ett hot mot samhället och den svenska regeringen vill motverka terrorismen genom att motverka terroristorganisationernas organisationsrätt. Uppsatsen avser att redogöra för föreningsfriheten för terroristmedlemmar i Sverige genom att studera den nuvarande regleringen av föreningsfriheten samt dess begränsningar. Vidare kommer även föreningsfrihetens framtid för terroristmedlemmar att undersökas genom att titta på den nya lagändringen som kriminaliserar samröre med terroristorganisationer och Justitiedepartementets förslag om kriminalisering av deltagande i terroristorganisationer.

Föreningsfriheten i regeringsformen är närmast absolut utformad och skyddar rätten för var och en att sammansluta sig med andra för allmänna och enskilda syften. Den skyddar även organisationens verksamhet och deltagandet i denna verksamhet. Kriminella handlingar som begås inom organisationens ramar är dock inte straffria.

Slutsatsen som dras i uppsatsen är att det inte finns något behov av att införa en begränsning av terroristorganisationers föreningsfrihet. Detta med bakgrund av att det redan finns en omfattande reglering av terrorism som tar sikte på den typ av kriminalitet som kan uppkomma inom terroristorganisationer. Vidare har NCT gjort bedömningen att det är större risk att ett attentat begås av en ensamagerande gärningsperson med våldsbejakande övertygelse än av ett organiserat nätverk. Risken för att en begränsning i föreningsfriheten sker bedöms trots detta som hög eftersom regeringen fortsatt ser terroristorganisationer som ett stort hot. (Less)

Sweden’s National center of terrorist threat assessment group (NCT) states that the threat of terrorism against Sweden is still increased. Terrorism and terrorist organizations pose a threat to the democratic society and the government of Sweden aims to protect its country from terrorist organizations by limiting their freedom of association.

This essay aims to describe the extent and limits of freedom of association which is enjoyed by members of terrorist organizations. The essay also aims to further discuss the future of their freedom of association by studying the recent efforts that have been made in the fight against terrorism. Sweden’s National center of terrorist threat assessment group (NCT) states that the threat of terrorism against Sweden is still increased. Terrorism and terrorist organizations pose a threat to the democratic society and the government of Sweden aims to protect its country from terrorist organizations by limiting their freedom of association.

This essay aims to describe the extent and limits of freedom of association which is enjoyed by members of terrorist organizations. The essay also aims to further discuss the future of their freedom of association by studying the recent efforts that have been made in the fight against terrorism. Such efforts consist of recent law adjustments that criminalize every involvement with a terrorist organization and the proposal by the Department of Justice that aims to criminalize any activity that occurs within a terrorist organization.

Freedom of association in Swedish law has an almost absolute form. The freedom of association protects both the right to create associations and the right to any activity within such association. Criminal activity within the association will, however, still result in legal consequences.

This essay’s results conclude that there is no need to limit the freedom of association for members of terrorist organizations since there is already thorough legislation that takes aim at the criminal activity that could occur within a terrorist organization. Furthermore, the NCT states that the threat of lone terrorist offenders who have been radicalized by social media is a bigger threat than that of a terrorist organization committing terrorist crimes. With that said there is still a high probability that terrorist organization members’ freedom of association will be limited in the future since the government of Sweden deems it as necessary to prevent terrorism.
