Abstract (Swedish)
För att undvika att brottsutredningar äventyras, säkerställa att gärningsmannen lagförs och undvika fortsatt brottslighet kan krävas att den som misstänks för brott frihetsberövas. Om den misstänkte har möjlighet att kommunicera med eventuella medbrottslingar eller får möjlighet att hota vittnen kan vad som skulle blivit en fällande dom istället innebära att brottsling går fri.

Å andra sidan innebär häktning av en misstänkt att en individ som ännu inte fått sin sak prövad i domstol nu sitter frihetsberövad och i många fall, isolerad under större delar av dygnet. Detta innebär en balansgång mellan det allmännas intresse att lagföra brottslingar och individens intresse av presumeras oskyldig fram tills dess motsatsen är bevisad.

Sverige har under en lång tid fått ta emot kritik av bland annat europarådet och FN:s kommitéer mot tortyr på grund av långa häktningstider och restriktioner vilket innebär isolering som kan likställas med psykologisk tortyr. Sverige har trots denna kritik gjort få lagändringar på området och långa häktningstider som präglas av isolering är fortfarande ett faktum. (Less)

In order to avoid jeopardizing criminal investigations, ensure that the perpetrator is prosecuted and avoiding further crime being committed it may be necessary to deprive a suspect of their liberty. If, given the opportunity, the suspect communicates with accomplices or intimidates witnesses what might have been a conviction could instead result in a criminal walking free.

On the other hand, detaining a suspect means depriving an individual, who has yet to prove their case in court, of their liberty and in many cases that means isolation for bigger parts of the day. This is a balancing act between the public's interest of prosecuting criminals and the individual’s interest of preserving their presumption of innocence.
