- Arbitration has long been used in business as a substitute for a traditional court process. Long processing times within the public court and the labor court have made arbitration an attractive alternative for employers. The disputing parties may also decide the arbitral tribunal themselves and that the dispute cannot be appealed on substantive grounds. On the other hand, the cost of the arbitral tribunal is usually covered by the losing party, which can result in a great financial strain for the financially weaker party.

The essay concludes that the arbitration clause is burdensome for the employee and therefore there are special requirements for clarity and a duty to provide information about the arbitration procedure. Furthermore, employees can receive financial support and representation from the association through their trade union, which means that the financial situation is equal to that of the employer. Should the employee be unbound, the precondition is that there is reason for the employer to introduce an arbitration clause in the individual employment contract. It may be that it is a position of trust, the employee processes sensitive or classified information or that the employee has a prominent position within the organization. The arbitration procedure must also satisfy an impartial arbitral tribunal. The thesis' conclusion is that the labor court is restrictive in adjusting the arbitration clause. Det kan vara att det rör sig om en förtroendegivande position, den anställda behandlar känslig eller sekretessbelagd information eller att den anställde har en framstående position inom organisationen. Skiljeförfarandet måste även tillgodose en opartisk skiljenämnd. Uppsatsens slutsats är att arbetsdomstolen är restriktiv i att jämka skiljeklausulen. Den anställda kan inte bara hävda att det är en ojämnställt ekonomiskt utan det krävs ytligare anledning till att skiljeklausul ska bortses ifrån. (Less)
