- Mellan åren 2015 och 2021 har lag om tillfälliga begränsningar av möjligheten att få uppehållstillstånd i Sverige varit gällande istället för utlänningslagen. Lagen infördes för att minska antalet asylsökanden och uppehållstillstånd i Sverige. Nu när den tillfälliga lagen slutar gälla har det kommit ett förslag på att permanent ändra utlänningslagen så att vissa bestämmelser är mer lika de som funnits i den tillfälliga lagen. Lagen infördes för att minska antalet asylsökanden och uppehållstillstånd i Sverige. Nu när den tillfälliga lagen slutar gälla har det kommit ett förslag på att permanent ändra utlänningslagen så att vissa bestämmelser är mer lika de som funnits i den tillfälliga lagen. En av dessa ändringar som föreslås i SOU 2020:54 och i prop. 2020/21:191 är att det som flykting eller alternativt skyddsbehövande inte längre ska vara möjligt att erhålla permanent uppehållstillstånd vid en första prövning. Det ska inte heller finnas någon möjlighet att överklaga ett beslut om tidsbegränsat uppehållstillstånd. Motiveringen till förslaget är enligt regeringen att det är viktigt att Sverige håller sig på EU:s miniminivåer och fortsatt minskar antalet asylsökande.
Samtidigt infördes barnkonventionen som ny svensk lag år 2020. Detta innebär att barns rättigheter fått ett ännu starkare fäste, särskilt då artikel 3 i barnkonventionen säger att barnets bästa ska beaktas vid alla beslut som rör barn. Det är utifrån denna artikeln som uppsatsen har granskat det nya lagförslaget. Generellt har tidsbegränsade uppehållstillstånd fått kritik för att inte vara till barns bästa. Undersökningar visar att tidsbegränsade uppehållstillstånd resulterar i ökad stress hos barn och kan leda till sämre sjukvård för barn. Det är därför intressant att granska hur barnkonventionen förhåller sig till förslaget om att tidsbegränsade uppehållstillstånd ska bli ny huvudregel i utlänningslagen. En rättsdogmatisk metod har använts och inslag av de lege ferenda har inkorporerats i slutsatsen och diskussionen. Detta eftersom lagförslaget inte är optimalt utformat utifrån barnkonventionen och förslag till förändringar av lagförslaget har därför redovisats. En stor del av artikel 3 i barnkonventionen är förenlig med förslaget och att vara barn ska inte vara en egen grund för uppehållstillstånd. Samtidigt saknas en ordentlig barnkonsekvensanalys i SOU 2020:54 och i prop. 2020/21:191. Detta i kombination med att inget utrymme ges för individuella bedömningar när det kommer till längden på uppehållstillstånd som ges till barn gör att förslaget inte är optimalt utformat utifrån artikel 3 i barnkonventionen. The temporary law expires on 19 July 2021 and therefore the government has decided to refer proposals to the Council on Legislation for amendments to the Aliens Act. According to the temporary law immigrants can only receive a temporary residence permit at the first initial decision. This is one of the regulations that the government wants to incorporate in the aliens act. As of now the Aliens Act is not following the EU minimum standards and the government wants to lower the number of applications for a residence permit in Sweden.

This is one of the regulations that the government wants to incorporate in the aliens act. As of now the Aliens Act is not following the EU minimum standards and the government wants to lower the number of applications for a residence permit in Sweden.
The Convention on the Rights of the Child became a Swedish law in 2020. Making the convention law clarified that a point of view based on the legal rights of the child should always be imposed in decisions concerning children. Article 3 in the convention states that any decision made by the government should always consider what is best for the child when they decide on matters related to children. Generally the rule about temporary residence permits has been criticised for not considering what is best for the child. Studies show that temporary permits can result in higher levels of stress and inferior health care for children. This essay will therefore examine how the bill of temporary permits as a permanent solution is following article 3 in the Convention on the Rights of the Child. The final discussion of the essay concludes that the bill in itself respects article 3 in the Convention on the Rights of the Child. Meanwhile every decision-making process that affects children must include an evaluation of the possible impact (positive or negative) on the child or children concerned. In this case the evaluation is not fully explained and what is in the child's best interest has not been fully considered. (Less)
