År 2019 tillsattes en utredning vars syfte var att ta ställning till om en enskild brottsrubricering för hedersrelaterat våld och förtryck bör införas i svensk lagstiftning samt hur en sådan bestämmelse bör utformas. Hedersbrottsutredningen kom fram till att det finns ett behov av ett särskilt hedersbrott. Detta motiverades av den kontext som hedersrelaterade gärningarna utövas i och den kränkning av brottsoffrets integritet, frid och frihet som upprepande av dessa gärningar kan innebära. År 2019 tillsattes en utredning vars syfte var att ta ställning till om en enskild brottsrubricering för hedersrelaterat våld och förtryck bör införas i svensk lagstiftning samt hur en sådan bestämmelse bör utformas. Hedersbrottsutredningen kom fram till att det finns ett behov av ett särskilt hedersbrott. Detta motiverades av den kontext som hedersrelaterade gärningarna utövas i och den kränkning av brottsoffrets integritet, frid och frihet som upprepande av dessa gärningar kan innebära. Den enskilda hedersbrottsrubriceringen förväntas få en viktig symbolfunktion och normgivande effekt. Uppsatsen har tagit sikte på att bedöma utredningens argumentation om rättfärdigande och utformning av lagförslaget utifrån relevanta kriminaliseringsprinciper och kriterier som bör beaktas vid införande av nya brottsrubriceringar. Detta har gjorts för att utreda behovet för och legitimeringen av införandet av en enskild hedersbrottsrubricering.

På grund av straffrättens repressiva natur, ställs det höga krav på argumentationen vid en ny kriminalisering. Det finns uppställda kriminaliseringsprinciper och kriterier i doktrin och utredningar som bör beaktas för att upprätthålla ett rättssäkert och effektivt straffrättssystem och därmed även förhindra urholkning av straffrätten. Med anledning av att det redan finns en straffskärpningsbestämmelse som är tillämplig vid brottslighet med heder som motiv, är det främst av intresse att undersöka bestämmelsens förenlighet med hänsyn till principen om ultima ratio, kriminaliseringens effektivitet och legalitetsprincipen.

Frågan om lagförslaget om ett särskilt hedersbrott är förenligt med relevanta straffrättsliga kriminaliseringsprinciper och kriterier har i uppsatsens slutliga diskussion besvarats nekande. I analysen konstateras att utredningens argumentation för legitimering av kriminaliseringen var bristfällig och att det finns flera invändningar mot utformningen av lagförslaget. (Less)

In 2019, an inquiry was appointed with the purpose of deciding whether an individual criminal classification of honor-related violence and oppression should be introduced in Swedish legislation and how such a penalty provision should be formulated. The Honor Crime Investigation concluded that there is a need for a special honor crime. This was motivated by the context in which honor-related acts are practiced and the violation of the victim’s integrity, peace and freedom that the repetition of these acts may entail. The Honor Crime Investigation concluded that there is a need for a special honor crime. This was motivated by the context in which honor-related acts are practiced and the violation of the victim’s integrity, peace and freedom that the repetition of these acts may entail. The individual honor crime classification is expected to have an important symbolic function and norm-setting effect. The thesis has aimed to assess the inquiry’s argumentation on justification and formation of the bill, on the basis of relevant criminalization principles and criteria that should be taken into account when introducing new criminal classifications. This has been done to investigate the need for and legitimization of the introduction of an individual classification of honor crime.

Due to the repressive nature of criminal law, high demands are placed on the argument for a new criminalization. There are established criminalization principles and criteria in doctrine and investigations that should be taken into account in order to maintain a legally secure and effective criminal justice system and thereby also prevent the erosion of criminal law. Due to the fact that there is already a penalty increase provision that applies to crime with honor as a motive, it is primarily of interest to examine the compatibility of the provision with regard to the ultima ratio principle, the effectiveness of the criminalization and the principle of legality.

The question of whether the bill on a special crime of honor is compatible with relevant criminal law criminalization principles and criteria has been answered negatively in the final discussion of the thesis. The analysis states that the inquiry’s argumentation for legitimizing the criminalization was deficient and that there are several objections to the formation of the bill. (Less)
