I denna uppsats undersöks vilka förutsättningar det finns att, inom ramen för nuvarande arbetsmiljölagstiftning, på ett tillfredsställande sätt leva upp till arbetsgivarens organisatoriska och sociala arbetsmiljöansvar då arbetstagaren på arbetsgivarens inrådan helt eller till stor del arbetar hemifrån. arbeta hemifrån under pandemin. Det konstateras i den rättsliga analysen att arbetsgivarens arbetsmiljöansvar som utgångspunkt är applicerbart vid arbete hemifrån. Ansvarsfördelningen har dock problematiserats på senare tid, då allt mer ansvar för bland annat riskbedömning avden organisatoriska och sociala arbetsmiljön har tillfallit arbetstagaren. Organisatoriska och sociala riskfaktorer kan bli mer påtagliga vid arbete hemifrån. Isolering och organisationskultur är två områden som det kan finnas särskild anledning att beakta i relation till arbetsledning och arbetsmiljöansvar. För att illustrera hur lagstiftningen kan tolkas och användas av praktiker presenteras en intervjustudie bestående av åtta intervjuer med chefer som delegerats
arbetsmiljöansvar. I intervjuerna framkom att omställningen har upplevts ha både positiv och negativ inverkan på organisatoriska och sociala arbetsmiljöfaktorer, vilket haft påverkan på arbetsgivarens arbetsmiljöansvar på flera sätt. De små nyanserna hos arbetstagaren upplevdes svårare att urskilja då den sociala interaktionen primärt skedde genom en skärm. En slutsats som dras är att arbetsgivarens lagstadgade arbetsmiljöansvar kan behöva förtydligas ytterligare
i relation till organisatoriska och sociala arbetsmiljöfrågor för att chefer med delegerat arbetsmiljöansvar ska kunna navigera genom subjektiva upplevelser och objektiva riskfaktorer. Området denna uppsats behandlar är komplext och kan tjäna på att undersökas med en tvärvetenskaplig ansats. Frågeställningen kan besvaras olika beroende på ifall lagens syfte anses uppnått genom dess implementering eller om syftet först är uppfyllt då den organisatoriska och sociala arbetsmiljön också ur arbetstagarens perspektiv upplevs som god. This thesis examines the conditions that exist, within the framework of current work environment legislation, to satisfactorily live up to the employer's organisational and social work environment responsibilities when the employee, on the employer's advice, works entirely or largely from home. The thesis focus on conditions applicable to conventional employment for white-collar workers, a professional category that has largely been able to switch to working
from home during the pandemic. It is stated in the legal analysis that the employer's work environment responsibility is applicable to work from home. However, the division of responsibilities has become problematic as more and more responsibility for, among other things, risk assessment of the organisational and social work environment has fallen to the employee. Organisational and social risk factors can increase when working from home. Isolation and organisational culture are two areas that there may be special reason to consider in relation to work management and work environment responsibility. To illustrate how the legislation can be interpreted and used by practitioners, an interview study is presented consisting of eight interviews with managers who have been delegated work environment responsibility. In the interviews, it emerged that the change has been experienced as having both a positive and negative impact on organisational and social work environment factors, which has had an impact on the employer's work environment responsibility in several ways.
The small nuances of the employee were found more difficult to distinguish as the social interaction took place primarily through a screen. One conclusion is that the employer's statutory work environment responsibility may need to be further clarified in relation to organisational and social work environment issues for managers with delegated work environment responsibility. to be able to navigate through subjective experiences and objective risk factors. The area covered by this thesis is complex and can benefit from being investigated with an interdisciplinary approach. The question can be answered differently depending on
whether the purpose of the law is considered to have been achieved through its implementation or if the purpose is only fulfilled when the organisational and social work environment is also perceived as satisfying from the employee's perspective. (Less)
