Patenthavarens skydd vid intrång - Fokus på skadestånd

Abstract
A patent is an intellectual property which gives the owner exclusive rights to the
innovation. As a patent holder one of the most important things of a patent might
be the protection it provides against intrusions. But if the patent is going to be able
to provide the intentional effect its required that sanctions it brings, in the shape of
financial damages are discouraging and proportionate but also work in practice, and
not only in theory.
The patent law in Sweden has come a long way since it was introduced and is till
changing. There is multiple cooperation within EU which aim to harmonize the
development on a more international level, the primary cooperation is the
2004/48/EG commonly known as the Enforcement... (More)
A patent is an intellectual property which gives the owner exclusive rights to the
innovation. As a patent holder one of the most important things of a patent might
be the protection it provides against intrusions. But if the patent is going to be able
to provide the intentional effect its required that sanctions it brings, in the shape of
financial damages are discouraging and proportionate but also work in practice, and
not only in theory.
The patent law in Sweden has come a long way since it was introduced and is till
changing. There is multiple cooperation within EU which aim to harmonize the
development on a more international level, the primary cooperation is the
2004/48/EG commonly known as the Enforcement Directive. The Enforcement
Directive is only aimed at civil law, such as financial damages. Because of this the
Enforcement Directive has led the civil laws within the cooperation to become more
harmonized and to create a better unified protection for the patent holders.
Unfortunately, the Enforcement Directive lacks an equivalent within the criminal
justice system. This in combination with insufficient case law and lack of
definitions in the law propositions which are needed to determine a sanction, results
in gaps in the law. On the other hand, there is hope that an unified court, through
the UPC agreement, in the future will be able to assist with more unified case law
and pronounced definitions which would result in a stronger patent protection for
the patent holders. (Less)

Ett patent är en immateriell rättighet som ger innehavaren en ensamrätt till
innovationen. Som patentinnehavare kan en av de viktigaste delarna av patentet
vara det patentskydd det medför, vilket ämnar skydda mot intrång. Men för att
patentskyddet ska kunna ge den tänkta effekten krävs det att sanktionerna,
patentskyddet medför, i form av ekonomiska skadestånd är avskräckande,
proportionerliga men också att de fungerar i praktiken och inte bara i teorin.
Patentlagstiftningen i Sverige har utvecklats mycket sen den kom till och gör så än

samarbetet har blivit mer harmoniserade och ett mer enhetligt skydd har uppstått
för patentinnehavarna. Sanktionsdirektivet har däremot inte fått någon
motsvarighet inom det straffrättsliga området. Vilket i kombination med bristfälliga
praxis och avsaknad på definitioner i propositioner som är relevanta vid
fastställandet av en sanktion, resulterar i att det fortfarande finns luckor. Däremot
finns det förhoppningar om att en enhetlig domstol, genom domstolsavtalet, i
framtiden ska kunna bistå med mer enhetliga praxis och tydligare definitioner som
resulterar i ett starkare patentskydd för patentinnehavarna. (Less)
