Abstract
The aim of this study was to investigate how gender and ethnicity are portrayed in court decisions according to 3 § LVU (Care of Young Persons Special Provisions Act). A total of 40 cases were requested by the administrative court in Malmö. 32 of these met the criteria and were selected as empirical material for the study. The chosen method for the study was a qualitative content analysis, which focuses on how phenomena are constructed in various texts. The aim of this study was to investigate how gender and ethnicity are portrayed in court decisions according to 3 § LVU (Care of Young Persons Special Provisions Act). A total of 40 cases were requested by the administrative court in Malmö. 32 of these met the criteria and were selected as empirical material for the study. The chosen method for the study was a qualitative content analysis, which focuses on how phenomena are constructed in various texts. The results showed that stereotypical gender norms were reproduced in the cases. Girls were considered more vulnerable, victimized and in need of protection. Boys, on the other hand, were to a greater extent described as responsible for their actions towards themselves and others. The findings indicate that the court cases were affected by male norms, such as aggressive and tough and female norms, such as emotional and vulnerable. In addition to gender, results showed indications of ethnicity in reference to themes such as mental health and aggressive behavior. Mental health was not mentioned at all for boys with foreign names, while aggressiveness was emphasized. This could indicate that the court cases are also influenced by stereotypical prejudices of them as tough. (Less)
