- Barnets bästa är den bärande principen i dagens barnrätt och härstammar ur såväl FN:s barnkonvention och föräldrabalken.1 Översiktligt går det att konstatera att de grundläggande tankarna om principen är att stärka respekten för barnets människovärde och integritet, samt som en etisk vägledning för alla enskilda bedömningar i mål som rör barnet. Det innebär att principen inte enbart ska tillämpas av beslutfattande organ utan även vara vägledande privata aktörer inom samhällssektorer. Samtidigt har även barnets rätt till delaktighet utvidgats jämsides med principen om barnets bästa.

Uppsatsen syftar inte till att ge en heltäckande belysning av föräldrabalken och barnkonventionen, utan snarare en fördjupad förståelse i begreppet som innebörd och tillämpningsinstrument. - It is stated in both the UN Convention on the Rights of the Child and the Children and Parents code, that all actions concerning children shall have the best interests of the child as the primary consideration. According to the 6th chapter 2(a) section in the Children and Parents code, the best interest of the child shall be the primary consideration in all questions concerning the child, both in legal and ethical matters. Article 3 in the UN Convention on the Rights of the Child states the same rights for the children and has been a great influence on the Swedish legal regulations. According to the 6th chapter 2(a) section in the Children and Parents code, the best interest of the child shall be the primary consideration in all questions concerning the child, both in legal and ethical matters. Article 3 in the UN Convention on the Rights of the Child states the same rights for the children and has been a great influence on the Swedish legal regulations. The regulations apply to both state and none-state actors in all matters that concern children. The child's right to be involved in all matters that concern them has improved simultaneously throughout the legislation of the regulation.
This essay aims to identify and embody what the best interest of the child is in correspondence to questions concerning custody. The principal purpose is to determine the definition on how the best interest of the child is conceptualized in the parental code and the convention. Purposely the essay means to give the reader an in-depth understanding concerning the complex regulations of the best interest of the child. (Less)
