Abstract (Swedish)
Denna uppsats utreder hur den krypterade chattplattformen EncroChat infiltrerades under våren 2020. Denna inledande utredning beskriver vad som är känt om infiltrationen, och vad som förblir okänt. Uppsatsen utvärderar denna process i allmänhet, och den svenska delen av processen i synnerhet, utifrån grundläggande straffprocessuella principer och rättssäkerhetsgarantier.
Uppsatsens viktigaste slutsatser är att förfarandet går att kritisera och ifrågasätta utifrån alla principer som inkluderats i framställningen. Det gäller särskilt på grund av att den sekretess som fört med sig en omfattande brist på information kring infiltrationen utgör ett rättssäkerhetsproblem i sig. Denna uppsats utreder hur den krypterade chattplattformen EncroChat infiltrerades under våren 2020. Denna inledande utredning beskriver vad som är känt om infiltrationen, och vad som förblir okänt. Uppsatsen utvärderar denna process i allmänhet, och den svenska delen av processen i synnerhet, utifrån grundläggande straffprocessuella principer och rättssäkerhetsgarantier.
Uppsatsens viktigaste slutsatser är att förfarandet går att kritisera och ifrågasätta utifrån alla principer som inkluderats i framställningen. Det gäller särskilt på grund av att den sekretess som fört med sig en omfattande brist på information kring infiltrationen utgör ett rättssäkerhetsproblem i sig. Denna analys görs utifrån en svensk kontext, med komplement av relevant EU- lagstiftning och praxis. Analysdelen är även underbyggd med hjälp av svenska hovrättsavgöranden i så kallade EncroChat-mål, där EncroChat-materialet utgör en stor del av den samlade bevisning, eller formulerat annorlunda, den avgörande bevisningen, i dessa mål. This thesis investigates how the encrypted chat network EncroChat was infiltrated during the spring of 2020. This introductory investigation describes what has been known about the infiltration, as well as what remains unknown. The thesis evaluates this infiltration project in general, and the Swedish part of the project in particular, on the basis of fundamental criminal procedural principles.
The most important conclusions of this thesis are that the process can be criticized on the merits of all such principles included in the thesis. This is due to - in particular - the confidentiality surrounding the project which has brought along a lack of information surrounding the infiltration. This thesis investigates how the encrypted chat network EncroChat was infiltrated during the spring of 2020. This introductory investigation describes what has been known about the infiltration, as well as what remains unknown. The thesis evaluates this infiltration project in general, and the Swedish part of the project in particular, on the basis of fundamental criminal procedural principles.
The most important conclusions of this thesis are that the process can be criticized on the merits of all such principles included in the thesis. This is due to - in particular - the confidentiality surrounding the project which has brought along a lack of information surrounding the infiltration. The lack of disclosed information in itself, is a problem from a legal certainty standpoint. The analysis is conducted primarily through the lens of a Swedish context, but also by examining relevant EU law and case law. The part of the thesis which constitutes the further analysis, is backed up by Swedish “Hovrätt”-rulings (Court of appeal) in so called EncroChat-proceedings. These proceedings are cases where EncroChat evidence constitutes a large part of the evidence material or, put differently, the decisive piece of evidence in these types of cases. (Less)
