Rättsprinciper eller trygghetsargument som lagstiftningsmotiv? En komparativ studie mellan Sverige och Danmarks lagstiftning mot gängkriminalitet

Gängkriminalitet har ökat det senaste årtiondet i både Danmark och Sverige. Trots de i princip identiska problemen har Danmark, men inte Sverige infört extraordinärt hårda regler mot personer vilka är verksamma inom ett kriminellt nätverk. Syftet för denna framställning är (1) dels att beskriva lagstiftningen/förslag beträffande gängkriminalitet i respektive land, (2) dels undersöka vilka skäl respektive land lyfter fram till stöd för vald lagstiftningsmetod.

Gängkriminalitet har ökat det senaste årtiondet i både Danmark och Sverige. Trots de i princip identiska problemen har Danmark, men inte Sverige infört extraordinärt hårda regler mot personer vilka är verksamma inom ett kriminellt nätverk. Syftet för denna framställning är (1) dels att beskriva lagstiftningen/förslag beträffande gängkriminalitet i respektive land, (2) dels undersöka vilka skäl respektive land lyfter fram till stöd för vald lagstiftningsmetod.

Analysmaterialet består av lagstiftning, lagförarbeten samt regeringsskrivningar i respektive land. Studien utgör en komparativ studie mellan Sveriges och Danmarks förhållningssätt till lagstiftning mot gängkriminalitet. Därutöver kommer en rättsdogmatisk metod att tillämpas i syfte att fastställa rättsutvecklingen samt gällande rätt i respektive land.

Resultatet i (1) visade att det fanns omfattande skillnader vad beträffar den straffrättsliga behandlingen av gängrelaterad brottslighet mellan länderna. Sverige intar en i förhållande till Danmark passiv inställning till straffhöjande åtgärder. De reglerna som finns i Danmark, finns inte i Sverige, och de åtgärder som föreslås i Sverige motsvarar i princip de straffskalor som redan finns i Danmark.

Beträffande resultatet i (2) legitimeras lagförslagen i Danmark genom ett utpekande av ett överordnat skyddsintresse som måste tryggas till varje pris. Skyddsintresset som motiverar de studerade lagförslagen är tryggheten för laglydiga samhällsmedborgare vilka riskerar att hamna i skottlinjen vid en gängrelaterad konflikt. De förslag vilka förts fram i Sverige är i högre utsträckning en produkt av avväganden mellan skyddsvärda intressen samt straffteoretiska utgångpunkter. Det görs avvägningar utifrån proportionalitetsprincipen, principen om ekvivalens, konsekvens, förutsebarhet och trovärdigt samt humanitetsprincipen. (Less)

Gang-related crime has increased the last decade in both Denmark and Sweden. Despite similar problems with organized crimes, the two countries have applied different approaches. Denmark has to a higher extent introduced extraordinarily strict rules against people who are active in an organized criminal gang. The purpose of this study is (1) to describe the legislation/proposals regarding gang-related crime in each country, and (2) to examine which reasons each country highlights to legitimize the chosen legislative method.

Denmark has to a higher extent introduced extraordinarily strict rules against people who are active in an organized criminal gang. The purpose of this study is (1) to describe the legislation/proposals regarding gang-related crime in each country, and (2) to examine which reasons each country highlights to legitimize the chosen legislative method.

The sources used for this paper consists of legislations, bills and government statements from each country. This is a comparative study between the approaches used by Sweden and Denmark in their legislation against gang related crime. In addition, legal dogmatic methods will be used to determine the legal development and applicable law in each country.

The results in (1) show that there are extensive differences in the criminal law against gang related crime between the countries. Sweden takes a passive approach to increased punitive measures in comparison to Denmark. The laws that exist in Denmark do not exist in Sweden, and the penalty increases proposed in Sweden mostly correspond to the penalty scales that already exists in Denmark.

The results in (2) highlights that the bills in Denmark are legitimized by designating an overriding protection interest that must be secured at all costs. The interest in protection that motivates the studied bills is the security for law-abiding citizens. The proposals that have been put forward in Sweden are to a greater extent a product of balances between interest’s worthy of protection and criminal theoretical starting points. Considerations are made between the principle of proportionality, the principle of equivalence, consistency, predictability and credibility, and the principle of humanity. (Less)
