- SiS särskilda ungdomshem är institutioner där barn och unga i behov av särskild tillsyn placeras, till största del sker detta med stöd av lagen (1990:52) med särskilda bestämmelser om vård av unga (LVU).
Uppsatsen syftar till att utreda i vilken utsträckning rätten till hälsa enligt artikel 24 i Förenta nationernas konvention om barnets rättigheter (barnkonventionen), är uppfylld för flickor med psykisk ohälsa, placerade vid SiS särskilda ungdomshem. Ämnet ska undersökas särskilt ur ett könsdiskrimineringsperspektiv. Avsikten är slutligen att undersöka dels vilka ändringar som kan ske i praktiken, och dels genom lagstiftning, för att eventuellt förbättra för ungdomar med psykisk ohälsa, vid de statliga ungdomshemmen. Uppsatsen syftar till att utreda i vilken utsträckning rätten till hälsa enligt artikel 24 i Förenta nationernas konvention om barnets rättigheter (barnkonventionen), är uppfylld för flickor med psykisk ohälsa, placerade vid SiS särskilda ungdomshem. Ämnet ska undersökas särskilt ur ett könsdiskrimineringsperspektiv. Avsikten är slutligen att undersöka dels vilka ändringar som kan ske i praktiken, och dels genom lagstiftning, för att eventuellt förbättra för ungdomar med psykisk ohälsa, vid de statliga ungdomshemmen. Metoden som har använts i uppsatsen är främst den rättsdogmatiska metoden.
Efter en genomgång av gällande rätt, granskning av SiS verksamhet samt genom att studera statistik gällande flickor med psykisk ohälsa vid ungdomshemmen, kan konstateras att det finns ett antal olika problem gällande möjligheterna att få vård för flickor med psykisk ohälsa. Resultatet av undersökningen är således att rätten till hälsa för flickor med psykisk ohälsa, placerade vid SiS ungdomshem, inte är uppfylld i tillräcklig utsträckning. Eftersom psykisk ohälsa är ett problem som drabbar flickor, placerade vid ungdomshemmen i större utsträckning än vad det drabbar pojkar, riskerar flickor med psykisk ohälsa att bli indirekt diskriminerade, då det visat sig vara svårt att få tillgång till tillräcklig psykiatrisk vård under placering. Vidare riskerar flickor med psykisk ohälsa att bli indirekt diskriminerade, då SiS verksamhet är mer anpassad efter ”pojkars problem”. En viktig aspekt för att rätten till hälsa ska vara uppfylld är dessutom att diskriminering i praktiken inte föreligger.
Det finns dock enligt min mening, ett antal förslag på ändringar, dels i praktiken och dels genom lagstiftning, som eventuellt kan förbättra för ungdomarna placerade vid SiS. Det vore exempelvis önskvärt att initiera en översyn av hälso- och sjukvårdslagen (2017:30) (HSL), för att säkerställa att ungdomar placerade vid SiS utanför sin hemregion, får tillgång till hälso- och sjukvård på samma sätt som övriga invånare i regionen. Ytterligare ett förbättringsområde är en stärkt samverkan mellan SiS, socialtjänsten och hälso- och sjukvården. Slutligen borde 32 § LVU förtydligas gällande syftet och omfattningen av en läkarundersökning före en placering vid de statliga ungdomshemmen, för att på ett bättre sett kunna säkerställa att ungdomarna vid SiS får vård utefter sina behov. act (SFS 1990:52) with special provisions on the care of young people (LVU).
The purpose of the thesis is to examine whether the right to health as
established in art. 24 of the UN Convention on the Rights of the Child, is
respected for girls with mental illness, who are placed in SiS youth homes.
The subject will be examined especially from a gender discrimination
perspective. Finally, the thesis intends to analyze what possible changes that
can take place, both in practice, and through legislation, in order to better
meet the needs of young people with mental illness, in SiS youth... (More) - SiS youth homes are institutions which provides compulsory care for young

The purpose of the thesis is to examine whether the right to health as
established in art. 24 of the UN Convention on the Rights of the Child, is
respected for girls with mental illness, who are placed in SiS youth homes.
The subject will be examined especially from a gender discrimination
perspective. Finally, the thesis intends to analyze what possible changes that
can take place, both in practice, and through legislation, in order to better
meet the needs of young people with mental illness, in SiS youth homes. The
thesis uses primarily a legal dogmatic method.
After reviewing current law, audits of SiS as an authority, and by studying
statistics and reports regarding girls with mental illness at SiS youth homes,
it can be stated that there are a several problems regarding the opportunities
to receive care for girls with mental illness. The analysis concludes that the
right to health for girls with mental illness, placed in SiS youth homes, in
general, is not sufficiently fulfilled. Since mental illness is a problem
affecting girls placed in the youth homes, to a higher extent than boys, there
is a risk of indirect discrimination, since it is difficult to access sufficient
psychiatric care during the time at the youth homes. Furthermore, the care in
the youth homes risks constituting discrimination because the youth homes is
mainly adapted to “boys” problems.
However, there are a number of different government bills and practical
changes, that in my opinion have the potential of possibly improving the
situation for the youths placed in SiS. It would, for example, be desirable to
initiate a review of the Health and Medical Services Act (SFS 2017:30) to
ensure that young people who are placed in SiS youth homes, outside their home region, have the same access to health care as other patients in the
region. Another area for potential improvement is the collaboration between
SiS, the social services and the health service. Furthermore, 32 § LVU should
be clarified regarding the purpose and the extent of a medical examination
before the compulsory care, in order to ensure that the young people at SiS
receive care according to their needs. (Less)
