Syftet med denna uppsats har varit att undersöka rekvisitet “annat socialt nedbrytande beteende” ur ett rättssäkerhetsperspektiv. Rättssäkerhet har definierats utifrån det formella rättssäkerhetsbegreppet med utgångspunkt i dess krav på förutsebarhet och likabehandling. Även efterlevnaden av domstolarnas motiveringsskyldighet har omfattats av arbetets definition av rättssäkerhet. Uppsatsen har haft en särskild inriktning på neuropsykiatriska funktionsnedsättningar och bestått av dels en deskriptiv, del där gällande rätt fastställs, dels av empirisk del. Syftet med denna uppsats har varit att undersöka rekvisitet “annat socialt nedbrytande beteende” ur ett rättssäkerhetsperspektiv. Rättssäkerhet har definierats utifrån det formella rättssäkerhetsbegreppet med utgångspunkt i dess krav på förutsebarhet och likabehandling. Även efterlevnaden av domstolarnas motiveringsskyldighet har omfattats av arbetets definition av rättssäkerhet. Uppsatsen har haft en särskild inriktning på neuropsykiatriska funktionsnedsättningar och bestått av dels en deskriptiv, del där gällande rätt fastställs, dels av empirisk del. Denna har bestått av en undersökning av underrättsavgöranden som syftat till att belysa hur rekvisitet tillämpats i praktiken. Den empiriska undersökningen har bestått av 74 avgöranden från tre olika förvaltningsrätter i Sverige. I uppsatsen har däremot enbart tio mål presenterats.

Av uppsatsens deskriptiva del har framgått att rekvisitet “annat socialt nedbrytande beteende” syftat till att täcka de situationer där en ung person befaras komma till skada på grund av sitt eget beteende. Begreppets vaga utformning lämnar ett stort tolkningsutrymme och det står därför inte klart vad som omfattas av rekvisitet. Detta har även bidragit till osäkerhet i dess tillämpning. Av empiriska undersökningen har bland annat framgått att beteenden som inte klart kan anses vara socialt nedbrytande har ansetts vara det. Målen som undersökts har därutöver till stor del bestått av bristande eller uteblivna motiveringar i domskälen, framförallt avseende sambandet mellan den unges beteende och dennes neuropsykiatriska funktionsnedsättning.

Slutsatsen är således att det tycks föreligga brister i det rättssäkerhetens krav på förutsebarhet, likabehandling och motiveringsskyldighet. Bristerna har gått att identifiera i både vad som anses vara gällande rätt samt tillämpningen av rätten i praktiken. (Less)

The purpose of this thesis has been to examine the prerequisite "socially destructive behavior", as it appears from the Care of Young Persons Act (LVU), from a legal certainty perspective. Legal certainty has been defined based on the formal concept of the word, based on its requirements for predictability and equal treatment. The courts' obligation of stating the grounds for decisions and judgements has also been covered by the thesis' definition of legal certainty. This paper has particularly focused on neuropsychiatric disabilities and consisted partly of a descriptive part where applicable law is established and partly of an empirical part which includes an examination of lower court decisions.

The descriptive part of the essay has shown that the prerequisite "other socially destructive behaviors" aimed to cover the situations where a young person is feared to be harmed due to his or her own behavior. The concept's vague design leaves a lot of room for interpretation, and it is therefore not clear what is covered by the prerequisite. This has contributed to uncertainties in the application of the law. The empirical study has shown, among other things, that behaviors that cannot clearly be considered socially destructive have been considered to be so in the judgments of the administrative courts’. Also, the examined cases have largely consisted of a lack of or no justification in the reasons for the judgment.

The conclusion is thus that there appear to be shortcomings in the legal certainty's requirement for predictability, equal treatment and the obligation to stating the grounds for decisions and judgements. The shortcomings have been identified in both what is considered to be applicable law and the application of the law in practice. (Less)
