- I svensk rätt uppställs i regel ett krav på uppsåt för samtliga allvarliga våldsbrott och även för försök till sådana. I svensk rätt har vi uppsåtsformerna direkt uppsåt, indirekt uppsåt och genom NJA 2004 s. 176 bestämde HD att uppsåtets nedre gräns ska vara ett likgiltighetsuppsåt. Uppsåtsformerna och uppsåtsbedömningen är dels dem samma för såväl fullbordade som icke-fullbordade brott, dels inte reglerade i lag utan i stället utvecklade genom doktrin och praxis.
Året 2010 kom den så kallade straffmätningsreformen. Reformens syfte var att skärpa straffen för allvarliga våldsbrott (straffvärdet och inte rubriceringsfrågan). Frågan är vilken effekt som introduceringen av den nya brottsformen kan innebära för bevisbedömningen av om det föreligger ett likgiltighetsuppsåt till den allvarliga brottsformen försök till mord. Samt vilken effekt som introduceringen kan ha på påbörjandet och försökspunkten till samma brott. (Less) - Abstract

In Swedish law we have three different types/degrees of intent: direct intent, intent eventualis (in Swedish law often referred to as indirect intent), and through the supreme court in 2004 – the lowest degree of intent is indifference-intent. The different types of intent and the criminal intent assessment are partly the same for both completed and attempted offences, partly not regulated by law but instead developed through doctrine and case-law.
In 2010 came the so-called sentencing reform. The purpose of the reform was to increase the penalties for serious violent offences (the value of the punishment and not the issue of... The purpose was that the penalty value should be higher than how case-law drafted similar act before the reform. Above all, for acts that involved a serious attack on someone's life or health or security of person. The reform also introduced a new type of offence, extreme aggravated assault.
The question is what type of effect the introduction of the new type of offence can have for the assessment of the evidence of whether there is an intentional indifference, particularly to attempted murder. And what effect the introduction can have on the assessment of intiation and attempt to the same offence. (Less)
