- Denna uppsats syftar till att ge en rättshistorisk redogörelse för
tvångsvården av alkohol- och narkotikamissbrukare i Sverige, från den
första lagen om behandling alkoholister 1913 till 1981 års LVM. Studien
fokuserar på lagstiftningens målgrupp, gränsdragningen mellan lagstiftning
om tvångsvård av missbrukare och psykiatrisk tvångsvård samt ansvaret för
att ansöka om och finansiera tvångsvården av missbrukare. Även
lagstiftarens syn på och skildring av missbrukaren samt hur detta påverkat
lagstiftningen undersöks. Förutom att studera lagtext är det framförallt
förarbetet, specifikt propositioner och utredningsbetänkanden som
undersökts.

fokuserar på lagstiftningens målgrupp, gränsdragningen mellan lagstiftning
om tvångsvård av missbrukare och psykiatrisk tvångsvård samt ansvaret för
att ansöka om och finansiera tvångsvården av missbrukare. Även
lagstiftarens syn på och skildring av missbrukaren samt hur detta påverkat
lagstiftningen undersöks. Förutom att studera lagtext är det framförallt
förarbetet, specifikt propositioner och utredningsbetänkanden som
undersökts.
Rättsutvecklingen gällande tvångsvård av missbrukare har gått
förhållandevis långsamt från 1913 års alkoholistlag till införandet av 1981
års LVM. Det syfte som angavs för den första alkoholistlagen, att skydda
övriga samhället från den fara och olägenhet missbrukarens
alkoholkonsumtion skapade, gällde i princip oförändrat för både 1931 års
alkoholistlag och för NvL. I enlighet härmed har inte heller målgruppen för
tvångsvården ändrats avsevärt. En särskild kommunal nämnd,
nykterhetsnämnden infördes 1913 med uppgift att ansöka om tvångsvård av
alkoholister och bevaka nykterhetsläget i kommunen. Även denna
institution förblev sig lik fram till 1979. Beträffande finansieringen av
tvångsvården påfördes till en början en vårdavgift på sökanden, vilket
innebär att nykterhetsnämnden till stor del svarade för kostnaderna.
Kostnadsbördan lyftes sedan gradvis från kommunerna för att istället täckas
av staten.
Ett generellt tema i diskursen kring lagstiftningen är frågan om ifall alkoholoch drogmissbruk främst skulle ses som ett socialt eller medicinskt problem. Hur denna fråga besvarades varierade något över tid. (Less) - Abstract
- This thesis aims to descibe the legal history of cumpulsory care of alcohol
and substance abusers in Sweden from the first Act on the Treatment of
Alcoholics in 1913 up until the Care of Abusers Special Provisions Act of
1981. Specifically, the study centers around the definition of the target
group of said legislation, the demarkation between legislation on
compulsory treatment of abusers and compulsory mental care, as well as the
municipal responsability for funding and applying for care of abusers. The
study also investigates legislators’ view and potrayal of abusers and how
this has affected legislation. Besides examining the text of law, the study
was carried out using primarily the legislative history.
The... (More) - This thesis aims to descibe the legal history of cumpulsory care of alcohol
and substance abusers in Sweden from the first Act on the Treatment of
Alcoholics in 1913 up until the Care of Abusers Special Provisions Act of
1981. Specifically, the study centers around the definition of the target
group of said legislation, the demarkation between legislation on
compulsory treatment of abusers and compulsory mental care, as well as the
municipal responsability for funding and applying for care of abusers. The
study also investigates legislators’ view and potrayal of abusers and how
this has affected legislation. Besides examining the text of law, the study
was carried out using primarily the legislative history.
The developement of the law concering compulsory treatment of abusers
was relatively slow during the time period of interest for this thesis. The
explicit aim of the compulsory treatment was to protect society from the
danger and inconvenience caused by the alcohol abuser. This aim remained
more or less the same from the passing of the first Act on the Treatment of
Alcoholics 1913 until the Social Services Act was passed in 1979. Since the
target group of the legislation was closely connected to its purpose, this too
was very similar throughout the studied period. A special municipal
committee, the sobriety committee was introduced in 1913 for the purpose
of applying for the compulsory care. This instituation remained the same
until 1979 aswell. Regarding the funding of the compulsory care, there was
initially a care fee inposed on the applying subject, meaning that the
sobriety committée was largely responsable for covering the costs. This
weight was later lifted gradually and instead covered by the state.
A general theme in discourse surrounding the legislation is wether alcohol
and substance abuse should be seen primarily as an issue of social or
medical concern. The answer to this question varied somewhat over time. (Less)
