- Privatimport av alkohol utgör en bråkdel av alkoholkonsumtionen i Sverige. Uppsatsen lyfter svårigheten i att främja och underlätta privatimport då Systembolaget har ett monopol på att assistera kunder till privatimport. Förhållandet mellan detaljhandel, privatimport och tillhandagåendeförbudet utrönas för att sedan visa på oklarheter i lagen och presentera gråzoner. Uppsatsen undersöker ett svenskt företags möjligheter att assistera konsumenter till privatimport genom att argumentera för om monopolet på privatimporttjänsten är proportionerligt och förenligt med EU-rätten. Förhållandet mellan detaljhandel, privatimport och tillhandagåendeförbudet utrönas för att sedan visa på oklarheter i lagen och presentera gråzoner. Uppsatsen undersöker ett svenskt företags möjligheter att assistera konsumenter till privatimport genom att argumentera för om monopolet på privatimporttjänsten är proportionerligt och förenligt med EU-rätten. Konkreta grundstenar presenteras för ett fiktivt verksamhetsupplägg som hade kunnat utgöra ett företag som bedriver tjänsten, assist till privatimport. Många av de argument som använts för att rättfärdiga privatimporten i sig kan användas för att rättfärdiga privatimporttjänsten. Därmed kan alkohollagen behöva ändras, antingen genom ett nytt undantag eller genom att modernisera tillhandagåendeförbudet. Genom ett nytt undantag genomgås samma process som skapades vid undantaget för privatimport. Det uppsatsen vill belysa är att privatimporttjänsten ska vara tillåten då monopolets utformning vad gäller privatimporttjänsten strider mot EU-rätten. (Less)

The thesis highlights the difficulty in promoting and facilitating private imports as Systembolaget has a monopoly on assisting customers with private imports. The relationship between retail, private imports and the prohibition on access is examined. Ambiguities in the law and unexplored ground is to then point out. The thesis examines a Swedish company's opportunities to assist consumers in private imports by arguing for whether the monopoly on the private import service is proportionate and compatible with EU law. Concrete cornerstones are presented for a fictitious business plan that could constitute a company that conducts the service, assist for private imports. Many of the arguments used to justify private importation itself can be used to justify private importation service. Thus, the Alcohol Act may need to be amended, either through a new exemption or by modernizing the prohibition on access. A new exemption will undergo the same process that was created with the exemption for private imports. What the thesis aims to highlight is that the private import service should be allowed as the monopoly's design regarding the private import service stands in contrary to EU law. (Less)
