- Följande uppsats undersöker den nationella självbestämmanderättens om-fattning och praktiska innebörd, i syfte att utreda huruvida denna innefattar en rätt till självständighet även utanför koloniala förhållanden. Detta sker genom en beskrivning och analys av gällande rätt enligt etablerade inter-nationella rättskällor, med fokus på Förenta nationernas traktat och resolut-ioner, Internationella domstolens rättspraxis samt internationell sedvane-rätt, utifrån en rättsdogmatisk metod. Utredningen visar att självbestäm-manderätten består av en etablerad och allmänt accepterad kärna omgärdad av lager av ökande ovisshet, där rättens innebörd blir alltmer omtvistad. - The following essay examines the right of self-determination of peoples in international law, seeking to determine whether this right encompasses a right to secession outside of colonial situations. In pursuit of this, applica-ble legal norms according to established sources of international law are described and analyzed, with a focus on the treaties and resolutions of the United Nations, the case law of the International Court of Justice and cus-tomary international law. The investigation shows that the right of self de-termination consists of an established and universally accepted core, sur-rounded by layers of increasing uncertainty, where interpretations of the right diverge.
