- Syftet med denna uppsats är att jämföra amerikansk och svensk materiell rätt angående förtal. På grund av att USA har ett common law system och Sverige har ett civil law system skiljer sig formerna för denna lagstiftning mycket åt. Det amerikanska common law systemet medför att det finns situationer där stater har rättskällor som motsäger varandra medan ett civil law system förväntas vara mer enat. Detta påverkar inte denna uppsatsen drastiskt eftersom majoriteten av skillnaderna är processuella. De rättskulturella skillnaderna är dock av stor betydelse när man jämför materiell rätt mellan länder.
Förtalslagstiftning måste förbli tillämplig även med förändringar i kultur och allmän opinion av vad som är socialt acceptabelt. Detta görs... De rättskulturella skillnaderna är dock av stor betydelse när man jämför materiell rätt mellan länder.
Förtalslagstiftning måste förbli tillämplig även med förändringar i kultur och allmän opinion av vad som är socialt acceptabelt. Detta görs genom att lämna mycket utrymme för domstolarna i båda länder att göra olika typer av bedömningar. Det finns många likheter i vilka saker som måste utvärderas i båda jurisdiktionerna, men det finns också anmärkningsvärda skillnader. Sanningen i ett förtalande uttalande är mer relevant i det amerikanska systemet, medan försvarlighet är av störst vikt i det svenska systemet. Det amerikanska rättssystemet har också mer explicita situationer där olika beviskrav tillämpas och det gör det mer förutsägbart för de inblandade parterna. (Less) - Abstract
- The purpose of this paper is to compare and contrast American and Swedish substantive law regarding defamation. Due to the US being a common law and Sweden being a civil law country the forms which this legislation takes differs greatly. The common law nature of the US system means that there are situations where states have sources of law which differ, while a civil law system would be more unified. This does not drastically affect this paper due to the majority of differences being procedural. The distinction between legal culture is however of large importance when comparing substantive law between countries.

Due to the vague nature of defamation law, as it has to stay applicable even with shifts in culture and public opinion of what is socially acceptable, the legislation of both countries lends itself to many points of consideration that have to be evaluated by the Courts. There are many similarities in which points need to be considered in both jurisdictions, but there are also notable differences. The truth of a defamatory statement is more relevant in the American system, while the defensibility is of primary concern in the Swedish system. The American legal system also has more explicit situations where different standards of proof are applied and that makes it more predictable for the parties involved. (Less)
