- Den kommunala självstyrelsen innebär bland annat att en kommun delvis själv får bestämma sitt uppdrag, hur omfattande detta ska vara och hur mycket
skatt som ska tas in för att finansiera dess genomförande.
Den gemenskap som utgör kommunen har därmed ett intresse av att kunna säkerställa att den kommunala självstyrelsen utövas inom ramen för vad som är tillåtet.
Förutom att de som utövar den kommunala makten kan ställas till politiskt ansvar genom de allmänna valen finns även möjligheten till en allmän medborgarkontroll genom laglighetsprövning av kommunala beslut.
I denna uppsats ställs och besvaras frågan om syftet med denna kontrollmöjlighet uppfylls genom det sätt som laglighetsprövningsinstitutet är utformat. Särskilt... I denna uppsats ställs och besvaras frågan om syftet med denna kontrollmöjlighet uppfylls genom det sätt som laglighetsprövningsinstitutet är utformat. Särskilt studeras aspekterna om vem som får begära prövning
av ett beslut och vilka organs beslut det är som får genomgå en prövning.
I uppsatsen tydliggörs att laglighetsprövningens utformning brister i
förhållande till dess syfte och att det delvis verkar vara ett medvetet val. (Less) - Abstract
- A Swedish municipality has a wide range of autonomy. As an effect of this self-government the municipality determines some of its mission by itself, including how much tax that must be collected to finance this.
The community that constitutes the municipality therefore has an interest to ensure that this autonomy is exercised within the range of what is permitted.
Besides the right to vote, and that possibility to hold local politicians accountable, there is also a possibility to request judicial review of municipal decisions.
This thesis asks and answers the question if this judicial review of the legality of a decision is fulfilled based on the purpose of the review, especially regarding who my request a review and which...
