Kompetensutvisningar - Små brister med stora konsekvenser

Abstract
During the year 2015 so called competence deportations became a phenomenon because of several verdicts from the Migration Court of Appeal. The meaning of the expression is that immigrants were denied continued work permits because of minor flaws in their applications. These flaws consisted of too little income compared to the boundary set up by the Swedish Migration Agency, lack of insurance or that the income did not meet the level of pay required in the relevant collective agreement.
Legislative amendments were introduced to reduce the occurrence of competence deportations and has led to a decrease in competence deportations. The combination of the precedents set by the court and the legislative amendments can be seen as a good example... (More)
During the year 2015 so called competence deportations became a phenomenon because of several verdicts from the Migration Court of Appeal. The meaning of the expression is that immigrants were denied continued work permits because of minor flaws in their applications. These flaws consisted of too little income compared to the boundary set up by the Swedish Migration Agency, lack of insurance or that the income did not meet the level of pay required in the relevant collective agreement.
Legislative amendments were introduced to reduce the occurrence of competence deportations and has led to a decrease in competence deportations. The combination of the precedents set by the court and the legislative amendments can be seen as a good example of effective legislation that has handled the issue quite well. A consequence of the legislative amendments is that the application process takes even more time than previously because the new rules are more complicated than before.
A revised version of an EU directive can change the rules yet again. The original directive from 2011 has been revised to improve the rules and the conditions for third-country workers in the EU. The focus of the revision is to shorten the application procedure, but the revision can also come to change the assessment made during the application process for work permits. The news would amount to that the specific circumstances of the case and the principle of proportionality should be considered when an application is rejected, when it is appropriate.
The directive can therefore bring new legislative changes in this legal area and reduce the risk of competence deportations occurring. (Less)

Kompetensutvisningar blev ett fenomen under 2015 i samband med ett antal rättsfall från Migrationsöverdomstolen. Innebörden var att personer med uppehållstillstånd på grund av arbete fick avslag på sina ansökningar om förlängning av sina uppehållstillstånd på grund av mindre brister. Bristerna utgjordes bland annat av att lönen inte hade nått upp till försörjningskravet uppställt av Migrationsverket, försäkringar saknades eller att lönen understeg en kollektivavtalsenlig nivå.

Det ursprungliga direktivet från 2011 har arbetats om för att förbättra reglerna och därigenom också förutsättningarna för tredjelandsmedborgare som arbetar inom EU. Framför allt ska ansökningsförfarandena förkortas, men det innehåller även en ändring som kan komma att påverka bedömningen vid ansökningar om uppehållstillstånd på grund av arbete. Nyheten innebär att omständigheterna i ärendet och proportionalitetsprincipen ska beaktas vid ett avslag av en sådan ansökan, när så är lämpligt.
Direktivet kan därför innebära ytterligare förändringar av lagstiftningen på området och bidra till att minska risken för att kompetensutvisningar sker. (Less)
