- Both section 33 and section 36 of the Swedish Contracts Act (1915:218) are general clauses which are a part of the field of contract law, but section 36 has a much greater scope of application. For this reason, section 33 has been described as redundant. However, in a recent judgement from the Patent and Market Court of Appeal section 33 was successfully used to force a gambling company to pay back the profits that they had made from a gambling addict. This poses the question whether the idea of section 33 being redundant might be wrong.
The purpose of this essay is to do a systematic legal investigation of what role and function section 33 has in relation to section 36. However, in a recent judgement from the Patent and Market Court of Appeal section 33 was successfully used to force a gambling company to pay back the profits that they had made from a gambling addict. This poses the question whether the idea of section 33 being redundant might be wrong.
The purpose of this essay is to do a systematic legal investigation of what role and function section 33 has in relation to section 36. In accordance with this purpose, the main question that this essay seeks to answer is whether or not section 33 has an independent scope of application in com-parison to section 36. To answer this question, the legal dogmatic method is used to investigate the current legal position using legislative history, court practice and legal literature. Considering that the legal position remains relatively unclear, the results are viewed from a critical perspective.
The results show that there at least exist situations where section 33 is the most appropriate to apply, since these situations fall within the narrower scope of application of section 33. These situations are at hand when one party has acted in such an immoral way during the conclusion of the con-tract that the contract should be completely annulled. However, this is not the same as saying that section 33 is the solely applicable rule in these situ-ations. On the contrary, it is most likely that section 36, considering its larger scope of application, would also be applicable. This will remain un-clear if the Supreme Court does not grant a review permit for an appeal against the judgement from the Patent and Market Court of Appeal. Re-gardless, the existence of section 33 is somewhat justified by its narrower scope of application focused on morality, and its unique relation to the spe-cific invalidity rules in sections 28-31 of The Contracts Act. Av detta skäl har 33 § AvtL beskrivits som i princip helt överflödig. Relativt nyligen kom dock en dom från PMÖD, där 33 § AvtL med framgång åberopades för att få ett spelbolag att betala tillbaka den vinst bolaget gjort på en person som var spelberoende. Detta väcker frågan om bilden av 33 § AvtL som överflödig inte riktigt stämmer.

I enlighet med detta syfte är den övergripande frågeställning som uppsatsen söker svar på huruvida 33 § AvtL har ett självständigt tillämpningsområde i förhållande till 36 § AvtL. För att svara på frågan används den rättsdogmatiska metoden för att utreda rättsläget med hjälp av förarbeten, doktrin och den praxis som rör tillämpningen av 33 § AvtL från tiden efter införandet av 36 § AvtL. Med hänsyn till att rättsläget är relativt oklart intas ett kritiskt perspektiv gentemot resultatet av den rättsdogmatiska utredningen.
Uppsatsen kommer fram till att det åtminstone står klart att det finns situationer då 33 § AvtL är mer lämplig att tillämpa än 36 § AvtL, eftersom dessa situationer faller inom 33 § AvtL:s snävare tillämpningsområde. Sådana situationer föreligger då en part agerat så pass omoraliskt i samband med rättshandlingens tillkomst att rättshandlingen bör ogiltigförklaras i sin helhet. Däremot kan inte med säkerhet sägas att 33 § AvtL är ensamt tillämplig i dessa situationer, utan det är tvärt om mest troligt att också 36 § AvtL hade gått att tillämpa. Detta förblir dock oklart fram till att HD eventuellt beviljar prövningstillstånd till ett överklagande av PMÖD:s dom och förtydligar rättsläget. Oaktat detta har 33 § AvtL åtminstone en särpräglad roll inom dagens avtalsrätt dels genom sitt snävare tillämpningsområde med fokus på moraliskt handlande, dels genom sitt särskilda förhållande till de specifika ogiltighetsreglerna i 28-31 §§ AvtL.
