Abstract
The aim of this study is to investigate the short term change regarding deprivation of liberty of children in Sweden. There has been media coverage on the subject since adolescents are committing grave crimes in Sweden and the politicians want to change how the children are deprived of their liberty. The study compares legislation from 2023, 2024 and a proposed legislation that could take effect in 2028, all of which address deprivation of liberty of children. The legislations is consequently compared to the Convention on the Rights of the Child. The aim of this study is to investigate the short term change regarding deprivation of liberty of children in Sweden. There has been media coverage on the subject since adolescents are committing grave crimes in Sweden and the politicians want to change how the children are deprived of their liberty. The study compares legislation from 2023, 2024 and a proposed legislation that could take effect in 2028, all of which address deprivation of liberty of children. The legislations is consequently compared to the Convention on the Rights of the Child. The material also consists of two interviews with two people who have great work experience at the institutional homes that these kids are held at as of now. Even though it is not possible to generalise the interviews due to the small selection of respondents, the interviews contribute to a deeper understanding of the context. Furthermore the results are analysed in the theoretical framework consisting of both Jeremy Bentham and Michel Foucault's theories about punishment, as well as the interest theory about human rights. The results indicated a restrictive development in the legal context which may impact children's rights. (Less)
