- Abstract (Swedish)
(More)

(Less)
- Abstract
- The paper deals with the development of Swedish confiscation legislation, with a particular focus on the transition from traditional forfeiture to extended forfeiture and the proposal for independent forfeiture. Forfeiture means that the state takes criminal gains from criminals. The extended forfeiture, introduced in 2008, allows for the seizure of property likely to be derived from criminal activity without having to prove a direct link to a specific offence. To further enhance the fight against economic crime, new legislation on independent forfeiture is now proposed. This means that the state can forfeit property based on an overall assessment of its origin and the owner's financial situation, without the need to prove a specific... (More)

To further enhance the fight against economic crime, new legislation on independent forfeiture is now proposed. This means that the state can forfeit property based on an overall assessment of its origin and the owner's financial situation, without the need to prove a specific offence. Critics point out that this can challenge legal certainty through lower standards of proof and the risk of arbitrary decisions. The paper analyses these aspects and proposes measures to balance effective law enforcement with legal certainty and proportionality. (Less)
