Summary
The trust in social institutions has throughout history been crucial for their continuance. In developed societies like Sweden, the citizens have to trust that prosecutions are processed correctly. The confidence in these proceedings is vital for the compliance of decisions and judgements. Clear communication is a requirement for trust to be built and strengthened. Texts produced and published by courts need to be written in a matter so the public can familiarize themselves and understand the legal process. Summary
The trust in social institutions has throughout history been crucial for their continuance. In developed societies like Sweden, the citizens have to trust that prosecutions are processed correctly. The confidence in these proceedings is vital for the compliance of decisions and judgements. Clear communication is a requirement for trust to be built and strengthened. Texts produced and published by courts need to be written in a matter so the public can familiarize themselves and understand the legal process. If courts fail to communicate in a comprehensive manner, their confidence for these legal institutions can be damaged. In 2023, the confidence in the Swedish legal system was damaged badly. A ten-year-old girl had been the victim of rape at the hands of an adult male. The district court sentenced the defendant to three years in jail for two counts of child rape. In its assessment, the court equated the word “snippa” (the Swedish colloquial word for vagina), which the girl had used her interrogations, with the actual word vagina. As a result, the requirements for child rape were fufilled since it meant the equating of words meant she was penetrated and not solely touched on the outside of her genitalia. However, the court of appeal looked deeper into the girl’s use of words and whether it was enough to reach the requirements for child rape. The court of appeal decided to do a lexical interpretation which resulted in an acquittal since neither the prosecutor, nor the court of appeal, had presented another criminal classification despite its close resemblance to a proven crime description. The supreme court stated that the court of appeal had committed a miscarriage of justice through their inaction to process related criminal classifications. The case was sent back to he court of appeal, whereby the district court’s judgment, including their interpretation of the word “snippa”, was ruled. Despite the accused being sentenced to three years imprisonment for two counts of child rape, the trust in the Swedish legal system was damaged. Confidence in legal system is created through the continuity and high quality of judgments. Furthermore, much emphasis is placed on whether a ruling is considered fair or not. Although this miscarriage of justice has damaged the trust that Swedish citizens have in in their legal system, it cannot be regarded as enough to risk its collapse. The consequence is rather that fewer victims come forward with their experiences which leads to a decrease in the number of crimes of this nature being reported. (Less)

Förtroendet för samhällsinstitutioner har genom historien varit avgörande för deras bestående. I utvecklade samhällen som Sverige behöver medborgarna förlita sig på att lagföringen görs korrekt. Förtroendet är i sin tur avgörande för att människor rättar sig efter domar och beslut. Tydlig kommunikation är vidare ett krav för att tilliten till domstolarna ska kunna byggas samt stärkas. De texter som publiceras av rättsväsendet behöver vara av karaktär så gemeneman kan sätta sig in och förstå hur rättsprocessen gått till. En tioårig flicka hade blivit utsatt för en våldtäkt av en vuxen man. Tingsrätten dömde den tilltalade till tre års fängelse för två fall av våldtäkt mot barn. I sin bedömning hade de likställt begreppet snippa, som flickan använt i sitt barnförhör, med begreppet vagina. Till följd av tingsrättens tolkning av flickans ordval uppnådde den styrkta brottsbeskrivningen brottet våldtäkt mot barn eftersom man konstaterade att flickan blivit penetrerad istället för enbart berörd på yttersidan av kroppen. I hovrätten lades stor tyng på flickans ordval för att beskriva huruvida det nådde upp till kraven för våldtäkt mot barn. Hovrätten ansåg att man skulle göra en lexikalisk tolkning vilket resulterade att man friande den tilltalade då åklagaren inte yrkat på alternativa brottsrubriceringar och domstolen inte heller prövade annat lagrum, trots att åtminstone ett närrelaterat brott var konstaterat styrkt. När högsta domstolen tog upp målet konstaterades det att hovrätten hade gjort sig skyldig till rättegångsfel genom sin passivitet att inte pröva någon närliggande brottsrubricering. Hovrätten återförvisades målet för ny prövning, varvid tingsrättens dom, inklusive deras begreppjämförelse, fastställdes. Trots att den tilltalade slutligen dömdes till tre års fängelse för två fall av våldtäkt av barn kan man dra slutsatsen att förtroende för det svenska rättssystemet tog skada. Detta till följd av att förtroendet skapas genom en kontinuerlig samt hög kvalité på dömandet. Vidare läggs även vikt vid om utgången anses rättvis eller inte. Trots att rättegångsfelet kan anses ha skadat tilliten de svenska medborgarna har för rättssystemet är det däremot inte rimligt att det skadats så pass gravt att det riskerar dess sammanbrott. En rimlig följd är dock att färre vågar trädda fram med sin historia vilket kommer resultera i ett ökat mörkertal. (Less)
