- Denna masteruppsats undersöker hur dataskyddaspekter beaktas i pre-förvärvsprocessen, särskilt under due diligence och i konkurrensrättsliga be-dömningar av företagskoncentrationer inom EU. GDPR prioriterar skyddet av personuppgifter genom strikta juridiska regler, medan EU:s kontroll av före-tagskoncentrationer istället fokuserar på datas potential att driva innovation, minska kostnader och öka konsumentens valmöjligheter. Skillnaden ligger i att due diligence syftar till att skydda individuella rättigheter, medan kontroll av företagskoncentrationer bedömer data som en konkurrensfördel och kon-kurrensrelaterade effekter inom marknadsdynamiken och överlåts skyddet av personuppgifter till en annan tillsynsmyndighet och bedöms inte direkt i... - Denna masteruppsats undersöker hur dataskyddaspekter beaktas i pre-förvärvsprocessen, särskilt under due diligence och i konkurrensrättsliga be-dömningar av företagskoncentrationer inom EU. GDPR prioriterar skyddet av personuppgifter genom strikta juridiska regler, medan EU:s kontroll av före-tagskoncentrationer istället fokuserar på datas potential att driva innovation, minska kostnader och öka konsumentens valmöjligheter. Skillnaden ligger i att due diligence syftar till att skydda individuella rättigheter, medan kontroll av företagskoncentrationer bedömer data som en konkurrensfördel och kon-kurrensrelaterade effekter inom marknadsdynamiken och överlåts skyddet av personuppgifter till en annan tillsynsmyndighet och bedöms inte direkt i kon-centrationsbedömningar.
Masteruppsatsen lyfter också fram de utmaningar som datadrivna företags-koncentrationer medför, såsom försämrat integritetsskydd, marknadsdomi-nans och den så kallade "privacy-paradox," där konsumenter byter sina data mot gratistjänster. Den undersöker även regleringsluckor i koncentrationsfall och diskuterar om det finns ett behov av att förena konkurrensrätten och data-skyddet i samband med företagskoncentrationer.
