Folkens och nationernas självbestämmande är en internationell rättslig princip som sträcker sig långt tillbaka i historien. Under perioden efter andra världskriget blev principen central i hanteringen av tidigare koloniala territorier. Ett sätt för ett område att uppnå självständighet, men under de förutsättningar som området själv kräver, blev den fria associationen. Ett sådant associationsförhållande utövas idag mellan USA och Marshallöarna. Samtidigt finns en an-nan relation mellan Danmark och Grönland, som reglerats genom den självstyreordning som upprättats mellan dem.

Under perioden efter andra världskriget blev principen central i hanteringen av tidigare koloniala territorier. Ett sätt för ett område att uppnå självständighet, men under de förutsättningar som området själv kräver, blev den fria associationen. Ett sådant associationsförhållande utövas idag mellan USA och Marshallöarna. Samtidigt finns en an-nan relation mellan Danmark och Grönland, som reglerats genom den självstyreordning som upprättats mellan dem.

Uppsatsen undersöker huruvida en eventuell fri association skulle kunna öka Grönlands möjligheter att delta i beslutsfattande om sin egen framtid och att bli taget seriöst, utifrån en teori om självbestämmanderätt. Detta görs genom en komparativ studie mellan den fria associationen som utövas på Marshallöarna och den nuvarande rättsliga konstruktionen som på Grönland. Vidare undersöks hur dessa konstruktioner har utvecklats historiskt.

De metoder som används är rättsdogmatisk metod för att utreda gällande rätt i relationen mellan dels USA och Marshallöarna, dels Danmark och Grönland. En komparativ metod används för att jämföra dessa två relationer. I bakgrunden används rättshistorisk metod för att belysa den historiska utvecklingen av dessa rättsliga ordningar, och för analysen används rättsanalytisk metod.

Utredningen drar slutsatsen att den danska självstyrelagen bidrar till ett grönländskt självbestämmande, men att en fri association skulle kunna stärka detta självbestämmande ytterligare. Slutligen konstateras att beslutet ligger hos Grönland och att det, utifrån ett självbestämmanderättsperspektiv, bör höras och tas seriöst. (Less)
Abstract
The right of all peoples’ and nations’ self-determination is an international legal principle that dates far back in history. During the period following the Second World War, it became central to the treatment of former colonial territories. One way for a territory to become independent, but under the prerequisites itself requires, became the free association. A free association relationship is currently exercised between the United States of America and the Marshall Islands. At the same time, there is another relation between Greenland and Denmark, stipulated in the self-government regulation established between them.

During the period following the Second World War, it became central to the treatment of former colonial territories. A free association relationship is currently exercised between the United States of America and the Marshall Islands. At the same time, there is another relation between Greenland and Denmark, stipulated in the self-government regulation established between them.

This thesis examines whether a free association would increase Greenland’s ability to participate in decisions about its future and to be taken seriously from the perspective of a theory of self-determination. This is done through a comparative study between the free association as exercised in the Marshall Islands, and the current legal construction in Greenland. Furthermore, the way that these legal constructions have developed historically is examined.

The methods used are legal doctrinal method to examine current law in the relationships between the United States and the Marshall Islands, as well as between Denmark and Greenland. A comparative method is used to contrast these two relationships. In the background, the legal historical method is applied to present the history behind the two legal constructions, and for the analysis, a legal analytical method is used.

The thesis concludes that the Danish Self-Government Act contributes to self-determination for Greenland, but that a free association could further increase Greenlandic self-determination. In the end it is concluded that the decision rests with Greenland and that, from a self-determination perspective, this decision should be heard and taken seriously. (Less)
