This study examines how the ideological tendencies of the President, the Senate and the Supreme Court influence presidential nominations to the United States Supreme Court during the period of 1947-1999. Using quantitative data, the analysis is based on ideology scores from ADA, DW-Nominate, and Segal-Cover to categorize nominations on the three regimes based on Moraski & Shipan’s theory of institutional constraints and choices. Legal instrumentalism is applied where the nomination deviates from the regime’s predictions, to complement the main theoretical framework of the regimes.
