- Lagen (2024:1180) om anonyma vittnen i brottmål trädde i kraft den 1 januari 2025 efter många år av utredningar och debatter. Lagen möjliggör att vittnen ska få höras anonymt under förundersökningen och i rättegång under vissa angivna förutsättningar.
Lagen är tänkt att knäcka gängkriminaliteten och bryta de tystnadskulturer som finns inom kriminella grupperingar. Den är även tänkt att skydda vittnen för att i sin tur få fler att våga vittna och därmed kunna lagföra dem som begår grova brott. Lagen är tänkt att knäcka gängkriminaliteten och bryta de tystnadskulturer som finns inom kriminella grupperingar. Den är även tänkt att skydda vittnen för att i sin tur få fler att våga vittna och därmed kunna lagföra dem som begår grova brott. Försvarsadvokater menar dock att lagstiftningen kommer leda till orimliga förväntningar om att få vittna anonymt som i sin tur får motsatt ef-fekt, nämligen att det leder till att färre brott klaras upp och vittnen istället kommer påstå att de inte minns händelsen.
Systemet med anonyma vittnen riskerar att åsidosätta vissa fundamentala rät-tigheter som finns för den åtalade eller tilltalade, bland annat rätten till en rätt-vis rättegång och rätten till ett effektivt försvar i enlighet med EKMR. För-svarsadvokaten har att bland annat åberopa bevis eller omständigheter som är till förmån för sin klient, en viktig del av det är att angripa tillförlitligheten på vittnet och skapa tvivel hos rätten. När ett vittne är anonymt blir det således svårare för försvaret att angripa tillförlitligheten när identitet och därmed motiv inte går att fastställa. Detta kan begränsa möjligheterna att på ett effektivt sätt bemöta vittnesmålet och de omständigheter som tas upp.
Denna uppsats har som syfte att undersöka hur försvarsadvokatens uppdrag gentemot sin klient och i en rättsprocess påverkas av det nya systemet med anonyma vittnen. Jag undersöker även vad det finns för rättssäkerhetspro-blem, både utifrån ett försvararperspektiv och mer allmänt utifrån grundläg-gande principer.
Dessutom analyserar och diskuterar jag kring hur anonyma vittnen har an-vänts hittills, både i Sverige och andra länder. Eftersom möjligheten att an-vända ett anonymt vittne ännu inte använts i Sverige analyserar jag kring hur jag tror att framtiden kommer att se ut med den nya lagen. Eftersom Sverige i jämförelse med andra länder i Europa är sena med att införa en sådan möjlig-het jämför jag även mycket kort hur det använts i andra länder med hur det är tänkt att användas i Sverige. The Act is intended to combat gang crime and to break the cultures of silence that exist within criminal groups. It is also intended to protect witnesses and encourage more people to come forward and testify in court and thereby pros-ecute more individuals who commit serious crimes. However, defense attor-neys believe that the legislation will lead to unreasonable expectations of being able to testify anonymously, which in turn will have the opposite... The system of anonymous witnesses’ risks disregarding certain fundamental rights that exist for the accused or the defendant, including the right to a fair trial and the right to an effective defense in accordance with the ECHR. The defense attorney has to, among other things, invoke evidence or circumstances that are in favor of the client, an important part of which is to attack the relia-bility of the witness and create doubts in the court. When a witness is anony-mous, it becomes more difficult for the defense to attack the reliability when the identity and the motive cannot be established. This can limit the possibili-ties of effectively responding to the testimony and the circumstances that are raised.
This essay aims to examine how the defense attorneys’ mission towards his client and in a legal process is affected by the new system of anonymous wit-nesses. I also examine what legal security problems there are, both from a defense attorneys’ perspective and in general from av constitutional principles perspective.
In addition, I analyze and discuss how anonymous witnesses have been used so far, both in Sweden and other countries. Since the possibility of using an anonymous witness has not yet been used in Sweden, I analyze what I believe the future will look like with the new law. Since Sweden, in comparison with other countries in Europe, is late in introducing such a possibility, I also very briefly compare how it has been used in other countries with how it is intend-ed to be used in Sweden.
