- Frånträdande av förhandsavtal vid förvärv av nyproducerad bostadsrätt har blivit en aktuell rättsfråga till följd av ökade kostnader för bostadsmarknaden. Förhandstecknare har låtit meddelas höjningar av årsavgiften avseende deras framtida bostadsrätt. Bostadsrättslagen innehåller särskilda regler för när det är möjligt att frånträda ett förhandsavtal och reglerar just frånträdande med väsentlig höjning av avgift som grund.
Vad som emellertid är att anse som väsentlig höjning är däremot inte definierat i lagen och har lämnats till rättstillämpningen att bedöma.
Domstolar har nyligen genomgående gjort bedömningen att även om en höjning av årsavgiften uppemot 50 procent sker, är höjningen ändå inte att betrakta som väsentlig. Det som... Vid bedömningen av om ett frånträde kan ske behöver det ske helhetsbedömningar i varje enskilt fall. Förhandstecknaren besitter ett konsumentliknande skydd, men

At the same time, the information contained in the cost calculation is preliminary by nature and may differ from the financial plan established closer to the commencement of the tenancy. Consequently, the assessment of whether withdrawal is justified requires an overall evaluation of the circumstances in each individual case.
Although advance purchasers are afforded consumer-like protection under the legislation, it is generally presumed that they have received and understood sufficient information when entering into the advance agreement. (Less)
