Abstract
This paper concerns the issue about juvenile delinquency and how social problems are constructed. The purpose has been to explore the debate about juvenile delinquency in Denmark and Sweden with the following sub-questions; which possibilities does the legislation give to put young people in institutional care by force? What problems are debated about juvenile delinquency in Denmark and Sweden today and who are in involved in this debate? I have used document-analysis as a method. This paper concerns the issue about juvenile delinquency and how social problems are constructed. The purpose has been to explore the debate about juvenile delinquency in Denmark and Sweden with the following sub-questions; which possibilities does the legislation give to put young people in institutional care by force? What problems are debated about juvenile delinquency in Denmark and Sweden today and who are in involved in this debate? I have used document-analysis as a method. I have studied preparatory work in Sweden about the new law called LSU, which from 990101 gives possibilities to sentence young people to serve time in institutional care instead of prison, and the Danish preparatory work that now is presented and proposes the establishment of a similar law in Denmark. I have also studied the debate in two papers in each country during the period 000101- 010524. The empirical base shows that the same problems are debated about juvenile delinquency in the two countries and that the political debate and the debate in the newspapers to high extent focus on the same problems. The main problems discussed are that more serious crimes is committed, young people commit crimes in gangs, rapes are committed by young people in gangs, and the fact that ethnic minorities often are overrepresented in juvenile delinquency. The political debate also claims that the legislation must give possibilities to sentence young people to proportional and equal punishment, and that it is not good enough to sentence serious criminals to care within the social welfare system, where the time in care is based upon the persons individual needs instead of the crime committed.
