- Since the opening of the Chinese borders in 1978, China has transformed in an unprecedented fashion. Constant economic reforms have converted the economy from a planned to a “socialist” market economy. Membership in the WTO has intensified China’s foreign trade and also integrated China in the world economy. Nonetheless, denial of Market Economy Status (MES) from its largest trading partner, the EU, constitutes a great challenge. Treatment of China within the EU as a Non-Market Economy allows the EU to enforce extensive antidumping measures against Chinese exports. Constant economic reforms have converted the economy from a planned to a “socialist” market economy. Membership in the WTO has intensified China’s foreign trade and also integrated China in the world economy. Nonetheless, denial of Market Economy Status (MES) from its largest trading partner, the EU, constitutes a great challenge. Treatment of China within the EU as a Non-Market Economy allows the EU to enforce extensive antidumping measures against Chinese exports. This is very frustrating to China, who considers the use of antidumping as protectionism as well as discrimination because the EU, from a Chinese perspective, disregards China’s economic reforms toward a market economy. The EU argues that it has denied China MES because China is yet to implement further liberalizing reforms before it can be awarded such a status. As this thesis will show, China has implemented significant reforms in compliance with WTO provisions. The thesis will also show that the effects of the EU’s lack
of concession in this regard could be extensive – economic decrease causing social instability in China and disturbance of the EU-China joint objective for Strategic Partnership being the most significant. (Less)
