Abstract
This thesis covers the concept of Responsibility to Protect (R2P) out of the perspective of international law. Buy looking into the fundament of sovereignty and humanitarian intervention the aim of the thesis is to answer the following questions:
• How does the implementation of R2P affect sovereignty?
• From the perspective of international law, is R2P considered to be legitimate?
The study concludes that implementation of R2P will negatively affect the principle of sovereignty in international law. This thesis covers the concept of Responsibility to Protect (R2P) out of the perspective of international law. Buy looking into the fundament of sovereignty and humanitarian intervention the aim of the thesis is to answer the following questions:
• How does the implementation of R2P affect sovereignty?
• From the perspective of international law, is R2P considered to be legitimate?
The study concludes that implementation of R2P will negatively affect the principle of sovereignty in international law. One of the big problems in this debate is that a redefinition of sovereignty is fully compatible with the policy objectives, but not with the legal. Nor is it possible that a reinterpretation of political sovereignty to coexist with a traditional legal interpretation. A reinterpretation of the legal sovereignty is not recommended as this would effectively mean a reformation of the entire international law.
International law is clear in the question of R2P's international legal legitimacy. R2P is to be regarded as a violation of the UN Charter and international law thus clearly illegitimate in that it regarded as a violation of the UN Charter essential values: the principle of sovereignty, the prohibition of violence and the rule of non-intervention.
