Abstract
The Constitution of Kenya has since the day it was created been a subject for discussion, debating about which political system the Kenyans should run. The thesis aims to investigate what problems the current constitution been dealing with and how these problems have lead to the demand for a new constitution and in what way this new constitution differs from the old.
Since independence the constitution has been severely criticized for being amended countless times to concentrate power in the presidency, it’s also been criticized for failing in devolving power to all ethnic groups in the country and to devolve power to the counties. The Constitution of Kenya has since the day it was created been a subject for discussion, debating about which political system the Kenyans should run. The thesis aims to investigate what problems the current constitution been dealing with and how these problems have lead to the demand for a new constitution and in what way this new constitution differs from the old.
Since independence the constitution has been severely criticized for being amended countless times to concentrate power in the presidency, it’s also been criticized for failing in devolving power to all ethnic groups in the country and to devolve power to the counties. This new constitution will remove power from the presidency and devolve it to the counties. It will also change the electoral system from the unfavorable majority system, first-past-the-post, to proportional representation, a system that implicates that all ethnic groups will be represented and not just a few.
The thesis analysis these two constitutions from the theoretical framework of Arend Lijpharts Consociational Democracy, where the theory constitutes an ideal model of how a constitution should look like in a pluralistic country. (Less)
