Since independence the constitution has been severely criticized for being amended countless times to concentrate power in the presidency, it’s also been criticized for failing in devolving power to all ethnic groups in the country and to devolve power to the counties. After more than 45 years with a criticized constitution a new was elected in a referendum on 4th of August 2010. This new constitution will remove power from the presidency and devolve it to the counties. It will also change the electoral system from the unfavorable majority system, first-past-the-post, to proportional representation, a system that implicates that all ethnic groups will be represented and not just a few.
The thesis analysis these two constitutions from the theoretical framework of Arend Lijpharts Consociational Democracy, where the theory constitutes an ideal model of how a constitution should look like in a pluralistic country. (Less)
