Uppsatsen handlar om 23 § MBL, som upptar rekvisiten för när ett kollektivavtal ska anses föreligga, och den allmänna avtalsrättens relevans vid dess tillämpning. Tanken är att peka ut områden inom den allmänna avtalsrätten som blir särskilt viktiga vid denna tillämpning.
Uppsatsen börjar med ett kapitel som kortfattat beskriver bakgrunden inom den allmänna avtalsrätten i de delar den av särskild betydelse för tillämpningen av 23 § MBL.

Härefter presenteras rekvisiten i 23 § MBL för när ett kollektivavtal ska anses föreligga. Sedan presenteras även ett kapitel angående betydelsen av behörighet att ingå kollektivavtal.

Att parterna, utöver att de tre rekvisiten i paragrafen ska vara uppfyllda, ska ha en avtalsavsikt är ett underförstått krav vid paragrafens tillämpning för att ett kollektivavtal ska anses föreligga. Ett kapitel om avtalsavsiktens betydelse vid tillämpningen presenteras därför. I detta kapitel tas vidare diskussionen om vilken typ av avsikt som krävs för att det ska vara fråga om ett kollektivavtal. Räcker det att parterna har en avsikt att sluta ett avtal, vilket som helst, eller krävs det en avsikt att sluta just ett kollektivavtal?

Vilka metoder Arbetsdomstolen använder sig av vid fastställande av innehållet i kollektivavtal gås vidare igenom för att illustrera de olika rekvisitens betydelse och tyngd.

I ett vidare perspektiv är ambitionen att för arbetsgivare peka ut sådant som kan vara viktigt för honom eller henne att känna till inför en MBL-förhandling.

Jag har dragit slutsatsen att, avtalsavsikten, anbud-accept-modellen och frågor om behörighet att sluta kollektivavtal utgör de områden inom den allmänna avtalsrätten som blir särskilt betydelsefulla vid tillämpningen av 23 § MBL. Dessa områden inom den allmänna avtalsrätten blir således viktiga för en arbetsgivare innan en MBL-förhandling. (Less)

This paper concerns Sec. 23 the Codetermination at Work Act, and the necessary conditions for when a collective agreement is considered to exist and the relevance of contract of law when it is applied. The idea is to point at areas within contract of law that becomes particularly important at the application.
The paper begins with a chapter that, in short terms, describes the background within contract of law in those parts where it is particularly important when applying Sec. 23 the Codetermination at Work Act.
Hereafter a presentation of the necessary conditions in Sec. 23 the Codetermination at Work Act for when a collective agreement is considered to exist is made.

This paper concerns Sec. 23 the Codetermination at Work Act, and the necessary conditions for when a collective agreement is considered to exist and the relevance of contract of law when it is applied. The idea is to point at areas within contract of law that becomes particularly important at the application.
The paper begins with a chapter that, in short terms, describes the background within contract of law in those parts where it is particularly important when applying Sec. 23 the Codetermination at Work Act.
Hereafter a presentation of the necessary conditions in Sec. 23 the Codetermination at Work Act for when a collective agreement is considered to exist is made.
The necessary conditions concern the form (in writing) prescribed by law, the parties and the contents of the agreement. Those conditions are scrupulously presented. Then a chapter on the competence to conclude a collective agreement is presented.

The necessary conditions must be met, but the parties must also have an intention to conclude an agreement, otherwise a collective agreement can not be considered to exist. This is an implied condition. A chapter on the relevance of the intention to conclude an agreement is therefore presented. Within this chapter, a discussion regarding what type of intention that is required is brought up. Is it enough that the parties has an intention to conclude an agreement, any agreement, or is it required that the intention shall be to conclude an agreement that has the nature of a collective agreement?

The principles of interpretation used by the Labour Court to fix the contents of collective agreements are also presented. This is primarily done to illustrate the significance of the necessary conditions within Sec.23.
In a wider perspective the ambition is to point to angles of such a nature that can be important to an employer before he or she enters into a situation of MBL negotiation.

I have come to the conclusion that the intention to conclude an agreement, the offer and acceptance model and questions concerning the competence to conclude an agreement are the areas within contract of law that becomes especially significant when Se. 23 the Codetermination at Work act is applied. These are consequently the areas within contract of law that becomes important to an employer before entering into a situation of MBL negotiation. (Less)
