- As the economic globalization has intensified worldwide and Sweden has become a member of the European Union we have in a short time experienced a dramatic change with the influx of migrant workers, also in the Swedish labour market. The increase of migrant labour against a background of free mobility in the EU has raised a number of new issues and problems. Above all questions of how migrant workers, both legal and illegal, should be protected in accordance with human rights law and conventions.
The point of departure of this paper is the fact that Sweden not yet has ratified the UN International Convention on the Protection of the rights of all Migrant Workers and their families, adopted by the UN General Assembly in 1990. The point of departure of this paper is the fact that Sweden not yet has ratified the UN International Convention on the Protection of the rights of all Migrant Workers and their families, adopted by the UN General Assembly in 1990. What arguments, if any, have been presented to defend or explain this decision?
My conclusion is that there exists an “active lack of interest” to ratify this convention, stemming from both historical and current political reasons. I have also noted a striking general lack of knowledge of the very existence of the Convention, not to speak of its actual content, which is remarkable seen in the context of a very intense international discussion about the impact of globalization also in the increasingly transnational labour markets.
