I Sverige får luftfartygsslagen helikopter och luftballong nyttja sig av allemansrätten gentemot markägare eller markinnehavare vid start och landning. Allemansrätten medger att mark där ingen bor eller som inte är i direkt anslutning till där någon bor får nyttjas av envar under förutsättning att ingenting förstörs. Det är inte tillåtet att ta betalt får sådant nyttjande om inte särskilt inrättade faciliteter har inrättats som nyttjas. Allemansrätten kan även användas kommersiellt för att fler ska kunna ta del av den.

Enbart för att marken kan nyttjas på allemansrättslig grund innebär det inte att det är fritt fram att starta eller landa där. Oavsett om marken nyttjas på allemansrättslig grund eller om det är nyttjarens egen mark gäller följande. Det kan finnas flygmässiga och operativa begränsningar som hindrar start eller landning på ett område. Sådana begränsningar behandlar inte uppsatsen. Vidare finns hänsynsregler i jordabalken, miljöbalken och numera även i luftfartslagen som måste följas.

Start eller landning på ett område som inte särskilt inrättats för sådant ändamål, utanför vad som vanligtvis benämns flygplats, får inte innebära nämnvärd skada eller olägenhet för omgivningen. I annat fall måste medgivande inhämtas från områdets ägare eller innehavare. Start eller landning får inte heller ske på samma område i allt för frekvent omfattning. En vägledning är att det krävs anmälan om antalet flygrörelser på samma område överstiger 500 årligen.

Skulle det däremot ske skada på marken ska denna ersättas. Principen är att markägaren eller markinnehavaren ska ersättas för mellanskillnaden mellan värdet som förelåg omedelbart innan skadan inträffade och efter. Ersättning för ren förmögenhetsskada såsom ersättning för bullerstörningar ersätts bara om skadan har inträffat genom en brottslig handling. Ett sådant exempel är en flygning där piloten uppsåtligen försummar eventuell skyldighet att inhämta medgivande från områdets ägare eller innehavare.

Uppsatsen behandlar inte personskador och givetvis ska skada på det som finns på marken såsom djur ersättas enligt samma princip som skador på marken. Ett luftfartygs ansvar är rent strikt vilket innebär att det inte krävs vållande för att ersättning ska kunna utgå. Däremot krävs adekvat kausalitet, samband, mellan flygningen och skadan.

Det finns en överenskommelse mellan Lantbrukarnas Riksförbund och Svenska Ballongfederationen som bl.a. reglerar ersättning vid förstörd mark. Överenskommelsen är frivillig att följa och bör inte anses utgöra branschpraxis. Däremot kan den i delar anses utgöra partsbruk om sådant blir aktuellt. I övrigt bör branschpraxis överensstämma med vad som på denna sida sägs. (Less)

The aircraft classes helicopter and balloon can in Sweden use the common right of access to private land in relation to land owners or someone to be in possession of land when taking off or landing. The common right of access to private land allows land where no one lives or isn’t in direct connection with where someone lives to be used by everybody as long as nothing is damaged. It is not allowed to take up payment for such use if not specific facilities are set up which are used. The common right of access to private land can also be used commercially.

For the sole reason that the land can be used on the basis of the common right of access to private land does not necessarily mean that it’s allowed to take off or land at that place.... (More)

For the sole reason that the land can be used on the basis of the common right of access to private land does not necessarily mean that it’s allowed to take off or land at that place. No matter if the land is used on the basis of the common right of access to private land or if it is used by someone in possession of the land the following is to be adhered to. There might be flying related or operational limitations which might prohibit take off or landing in an area. This essay does not deal with such limitations. It is necessary to pay due regard to the neighbourhood in accordance with the Real Property Code, the environmental law and the air law.

Take off or landing in an area outside of an airport must not damage or disturb the neighbourhood appreciably. Otherwise permission is needed from the land owners or those in possession of the land in the neighbourhood. Take off or landing must not occur in the same area too frequently. Guidance is that a notification needs to be made to the relevant authority if the total amount of flight movements exceeds 500 in a year.

Any damage to the land shall be compensated. Compensation is based on the total economical loss of the damage. Compensation for capital loss only, such as noise pollution, can only be claimed if the damage occurred due to a criminal act. Such an example is a flight where the pilot intentionally neglects the possible obligation to obtain prior permission from the land owner or someone to be in possession of the land.

The essay does not deal with bodily injury. Damage on property on the ground such as animals is compensated on the same principle as damage to the land. An aircraft has liability without fault but there need to be a connection between the aircraft flight and the damage.

There is an agreement between The Federation of Swedish Farmers and The Federation of Swedish Balloons which among other things regulates compensation for damaged land. The agreement is voluntary to adhere to and should not constitute business practice. On the contrary the agreement can in parts constitute a course of dealing if applicable. As for the rest business practice should correspond with what is said on this page. (Less)
