Ansvarsutkrävandet på den transnationella arenan har idag avsevärda brister som för med sig en omfattande straffrihet för transnationella aktörer. Denna uppsats undersöker hur dessa brister gestaltar sig när det kommer till företagsverksamhet. Undersökningen illustreras av Bhopalkatastrofen 1984, en händelse för vilken ansvar ännu, efter nästan 27 år, inte utkrävts.
Undersökningen bygger på teorier om moraliskt ansvar, företagsansvar och statsansvar. Den moraliska ansvarsanalysen bygger på kosmopolitismen och på det sunda förnuftets etik. Uppsatsens resultat tyder på att ansvaret för efterlevnad av mänskliga rättigheter och för ansvarsutkrävande för kränkningar av dem tillfaller staterna, och att en förbättring är beroende av staternas kollektiva vilja att prioritera dessa problem. (Less)

Accountability in the transnational arena today has significant flaws, which results in an extensive impunity for transnational actors. This paper examines how these flaws represent themselves when it comes to business. The examination is illustrated by the Bhopal disaster in 1984, an event for which responsibility has not yet been charged though nearly 27 years have passed.
This study is based on theories of moral, corporate and state responsibility. The moral responsibility part of the analysis is based on cosmopolitanism and the commonsense conception of moral responsibility. The essay results suggest that the responsibility for respecting human rights and assigning accountability for their violations are prerogatives of states and that improvements in this area are dependent on the States’ collective will to give priority to these problems. (Less)
