The purpose of this essay is to decide whether or not the detentions violate human rights in theory and practice. To gain this knowledge the author has examined the Swedish law, international conventions and declarations of human rights, and national reports and investigations of the detentions. The conclusion revolves around arbitrary detention and the process of it and also the right to health and the right not to be treated inhumanely or cruel.
Further the essay discusses how the creation of “the other” affects the migration law and policy, and also how the concept of security creates legitimacy for human rights violation. (Less)
