En effektivare människohandelsbestämmelse? - En studie av 2010 års lagändring

Under år 2010 genomfördes en lagändring rörande den svenska bestämmelsen i BrB 4 kap. 1a § avseende människohandelsbrottet.
Ändringen föranleddes av att problematik avseende bestämmelsens tillämpning och effektivitet hade uppmärksammats. Inom ramen för den utredning som tillsattes med anledning av detta identifierades fem problemområden avseende människohandelsbestämmelsens utformning; i) användandet av otillbörliga medel, ii) handelåtgärdernas utformning, iii) kontrollrekvisitet, iv) ersättning mot samtycke, och v) uppsåtsrekvisitet. Ändringen föranleddes av att problematik avseende bestämmelsens tillämpning och effektivitet hade uppmärksammats. Inom ramen för den utredning som tillsattes med anledning av detta identifierades fem problemområden avseende människohandelsbestämmelsens utformning; i) användandet av otillbörliga medel, ii) handelåtgärdernas utformning, iii) kontrollrekvisitet, iv) ersättning mot samtycke, och v) uppsåtsrekvisitet. Problematiken avseende dessa områden utgjordes i huvudsak av en oklar begreppsbildning och bevisproblematik vid tillämpningen av bestämmelsen. De huvudsakliga åtgärder och lösningar som föreslogs i utredningen bestod bland annat av att utmönstra kontrollrekvisitet, och att förändra kravet på uppsåt i relation till de tilltänkta utnyttjandena, från att endast ha omfattat avsiktsuppsåt till att även omfatta insikts- och likgiltighetsuppsåt. I övrigt föreslogs mindre ändringar av bestämmelsen. Förutom kontrollrekvisitets utmönstrande hörsammades emellertid inte majoriteten av utredningens förslag av regeringen. Regeringen fokuserade istället på den svenska bestämmelsens överensstämmande med de internationella instrumenten. För det fall utredningens förslag fått större genomslag hade troligen intentionerna med lagändringen i större utsträckning uppnåtts. De få ändringar av människohandelsbestämmelsen som 2010 års lagändring medförde, torde dock innebära att de intentioner som lagstiftaren hade med ändringen inte uppfylls. (Less)
Abstract
In 2010, a legislative amendment was passed regarding the Swedish Penal Code provision in chapter 4 article 1 a, regarding human trafficking. The amendment was induced after problems concerning the effectiveness of the provision that had been observed. Within the proposal from the appointed committee in response to this, five problem areas was identified; i) the use of improper means, ii) the wording of the trade measures, iii) the necessary prerequisite regarding control, iv) the reimbursement for consent and v) the necessary prerequisite regarding intent. In 2010, a legislative amendment was passed regarding the Swedish Penal Code provision in chapter 4 article 1 a, regarding human trafficking. The amendment was induced after problems concerning the effectiveness of the provision that had been observed. Within the proposal from the appointed committee in response to this, five problem areas was identified; i) the use of improper means, ii) the wording of the trade measures, iii) the necessary prerequisite regarding control, iv) the reimbursement for consent and v) the necessary prerequisite regarding intent. The problems relating to these areas mainly consisted of an unclear conceptualization and problems with the application of the provision in respect of evidence. The main actions and solutions proposed by the committee regarded the removal of the prerequisite regarding control, and the change of the prerequisite regarding intent in relation to the intended exploitation, changing it from only including direct intent to also including indirect and intent based on indifference (“likgiltighetsuppsåt”). Moreover only minor changes were proposed. With exception of the removal of the prerequisite regarding control, the majority of the proposals made by the committee were not accepted by the government. Instead the government focused on the correspondence between the Swedish provision and the international regulations in the area. If the proposals made by the committee had been given more impact, the intentions of the amendment would likely have been achieved to a greater extent. However, the few changes made to the provision regarding human trafficking following the 2010 legislative amendment, will probably result in the intentions set up by the legislator not being fulfilled.
