Den här uppsatsen handlar om koreografens rätt till skydd för sina verk. Jag diskuterar tre rättsliga problem med detta skydd. Det första handlar om svårigheterna att dra gränsen mellan koreografens nya skapande i förhållande till tidigare verk. Nya koreografier bygger ofta på gamla dansmönster och steg. Svårigheter kan uppstå med att bestämma var det ena verket slutar och det andra börjar. Det andra rättsliga problemet handlar om gränsdragningen mellan flera dansares och koreografens skydd för sina respektive ensamrätter. Dansen innehåller ofta inga bestämda roller, utan bygger på ett nära samarbete mellan flera medverkande. Den här uppsatsen handlar om koreografens rätt till skydd för sina verk. Jag diskuterar tre rättsliga problem med detta skydd. Det första handlar om svårigheterna att dra gränsen mellan koreografens nya skapande i förhållande till tidigare verk. Nya koreografier bygger ofta på gamla dansmönster och steg. Svårigheter kan uppstå med att bestämma var det ena verket slutar och det andra börjar. Det andra rättsliga problemet handlar om gränsdragningen mellan flera dansares och koreografens skydd för sina respektive ensamrätter. Dansen innehåller ofta inga bestämda roller, utan bygger på ett nära samarbete mellan flera medverkande. Koreografens skapelse förblir osynlig om den inte uttrycks av dansarna, vilket gör att dansarna blir en del av verket. Det tredje rättsliga problemet hänger samman med koreografens skyldighet att bevisa det egna verkets existens. Till skillnad från exempelvis filmverk och bokverk, tar koreografi sig uttryck i en icke-fixerad form, vilket leder till stora bevissvårigheter för koreografen.
Förutom dessa rättsliga problem, diskuteras i uppsatsen de rättsliga lösningarna i den svenska upphovsrättslagen på dessa problem. I uppsatsen konstateras flera allvarliga brister i det skydd till sina verk som upphovsrättslagen ger koreografen, till skillnad från t.ex. regissörens rätt till skydd för sina skapelser. (Less)

This essay discusses the choreographer's right to protection of their works. I discuss three legal problems with this protection. The first is the difficulty to draw the line between choreographer's new building in relation to earlier works. New choreographies are often based on ancient dance patterns and steps. Difficulties may arise in deciding where one work ends and the other begins. The second legal issue concerns the distinction between several dancers and choreographer's protection of their exclusive rights. The dance often contains no specific roles, but based on close cooperation between several participants. This essay discusses the choreographer's right to protection of their works. I discuss three legal problems with this protection. The first is the difficulty to draw the line between choreographer's new building in relation to earlier works. New choreographies are often based on ancient dance patterns and steps. Difficulties may arise in deciding where one work ends and the other begins. The second legal issue concerns the distinction between several dancers and choreographer's protection of their exclusive rights. The dance often contains no specific roles, but based on close cooperation between several participants. Choreographer's creation remains invisible unless it is expressed by the dancers, allowing the dancers become part of the work. The third legal problem related to the choreographer's obligation to prove their plant's existence. Unlike the films and books, choreography takes the form of a non-fixed form, leading to major difficulties with evidence of the choreographer.
In addition to these legal problems, discussed in the paper the legal solutions in the Swedish Copyright Act to these problems. The paper noted several shortcomings in the protection of their works which copyright law gives the choreographer, in contrast to a director's right to protect their creations. (Less)
