Detta arbete kommer i mångt och mycket handla om bostadsrättslagens 7 kapitel. Här utmönstras de rättigheter och skyldigheter som bostadsrätten är bärare av. Men även vilka möjligheter bostadsrättsföreningen har och vilka skyldigheter de har gentemot nyttjanderättshavarna i föreningens fastighet. Jämförelser kommer att göras mot hyreslagen då många av de förändringar som trädde i kraft i bostadsrättslagen den 1 april 2003 är skapade med hyreslagen som förebild.

Vad händer om bostadsrättshavaren orsakar skador på annan del av fastigheten som är utanför den egna lägenheten? Vad kan anses vara en störning enligt bostadsrättslagen och vilka uppgifter har föreningen då? Hur förverkas bostadsrätten?

Vad får man göra i den egna lägenheten och vilka sanktioner existerar om man går utanför dessa ramar?

Sammanfattningsvis så finns det väldigt få sanktioner i bostadsrättslagen för att få bukt med störningar och de som bryter mot ordnings- och trivselregler så som regelverket ser ut idag. Att vräka någon kan vara onödigt hårt i många situationer. Därför förespråkas att bostadsrättsföreningar i sina ordningsregler inför en form av vite vid överträdelse för att få nyttjanderättshavarna att följa regler vad gäller tillståndsplikt för t.ex. ombyggnad. Abstract
This work will largely focus on tenant owners association law, Bostadsrättslagen (1991:614) and specialize on the 7:th chapter in this regulation. In Sweden there is a specific law that regulates the purchase of an apartment in a tenant owners association. The rules are different from the purchase of a property. An apartment in a tenant owners association means that you buy a part in the association and not the apartment itself. Every apartment in the association is a carrier of a percentage of the association’s property. To be able to live in an apartment in the association’s property the buyer need to become a member in the tenant owners association. This work will largely focus on tenant owners association law, Bostadsrättslagen (1991:614) and specialize on the 7:th chapter in this regulation. In Sweden there is a specific law that regulates the purchase of an apartment in a tenant owners association. The rules are different from the purchase of a property. An apartment in a tenant owners association means that you buy a part in the association and not the apartment itself. Every apartment in the association is a carrier of a percentage of the association’s property. To be able to live in an apartment in the association’s property the buyer need to become a member in the tenant owners association. The 7:th chapter in bostadsrättslagen concerns the rules that both the tenant owners association and the members in the association that lives in the flats in the tenants owners association property. What kind of obligations do the members have to obey and what responsibilities does the tenants owners association have against the tenant-owners?
What kind of rights do the members have when there are disturbances in the associations’ property? And what can the tenant owners association do about disturbance? In this essay different types of annoyances are discussed smell, smoking and urinating, hostile screaming neighbors and crying babies.

What do the tenants living in a flat have to do to be a good tenant? Here come questions about regular maintenance 7:12 BrL, but also what happens if the tenant-owners start rebuilding their homes without permission from the association? The tenants must have permission if rebuilding includes main pipes and solid/ supportive walls.
What if the tenant-owners cause damage to another part of the property outside their own homes? What are the obligations then?
When can the tenant owners association get a tenant evicted because of the situations described above?

In summary there are very few penalties tenant owners association law can use do to get rid of the disturbance and those who break the rules for comfort so that the acquis is today. The only sanction is to evict the tenant, and that can be very hard in many situations. Therefore, the tenant owners association can in its regulations impose a form of fines for infringements of the rights tenant-owners have to follow. (Less)
