- Abstract
- The purpose of this study was to examine how gender is perceived in rulings regarding forced incarceration of individuals with life threatening addiction problems. More specifically: is there a difference in how Swedish courts perceive men and women? The study is based on court rulings. By examining these rulings and viewing them in the light of existing theories observations could be made regarding differences especially when it comes to how these women and men are portrayed. For women the most obvious case is the treating of motherhood in these court rulings. Many of the men are also parents but children are not taken into consideration when a ruling is made for a man. Another significant observation is the way in which criminal behaviour is described. It is only in rulings concerning men that criminal behaviour is taken into account when the argument for forced incarceration is founded. Why do such differences occur? By examining gender theory I view possible explanations. (Less)
