The purpose of the present essay is to describe what happens to the rights of parents and children when a child falls fatally ill. The method involves the comparison of scholarly literature, chiefly from Sweden, but also from Norway and the UK. Likewise dialogue has been carried out with the relevant parties in this matter, including personal contact with both physicians and Patientnämnden (the Swedish Board of Patients) in order to achieve a less rigid perception of the matter in question. This seems to indicate that the rights of parents are put in the background, when the surgeon diagnoses the child as being terminally ill. The essay describes the imbalance of power among the three parties of the constellation: physician, parents and child. The essay further mentions how the participation of the parents in ethical councils might decrease the gap in said imbalance in the distribution of power, and why this would be desirable for the Swedish government. The essay also points out the advantages of altering the forensic and economic framework of the matter rather than such changes impairing the goals of the palliative care. (Less)
