Abstract
The purpose of my paper is to explain how the lack of a violence ban in the constitution of Yemen is affecting women and prevents their rights regarding the Elimination of All Forms of Discrimination against Women (CEDAW). CEDAW is an international law which Yemen has adopted and they are obligated to accommodate women’s rights. Based on Yemen’s prehistory, customs, tradition and culture have affected women and violence has become a social accepted norm. Yemen’s constitution is based on the Islamic law sharia. I will explain how sharia limits women to have the benefit to their rights in relation to CEDAW. The purpose of my paper is to explain how the lack of a violence ban in the constitution of Yemen is affecting women and prevents their rights regarding the Elimination of All Forms of Discrimination against Women (CEDAW). CEDAW is an international law which Yemen has adopted and they are obligated to accommodate women’s rights. Based on Yemen’s prehistory, customs, tradition and culture have affected women and violence has become a social accepted norm. Yemen’s constitution is based on the Islamic law sharia. I will explain how sharia limits women to have the benefit to their rights in relation to CEDAW. For that reason, I will argue that it’s necessary to separate religion and law in order to implement women’s rights in the constitution of Yemen. The family law and Personal Status law is based on Islamic traditional law and part of the constitution of Yemen. The laws will be discussed as the main sources that both legitimizing the violence and the discrimination against women. The conclusion of my purpose will confirm that the lack of a violence ban in Yemen’s constitution is the strongest indicator which discriminates women and prevents women’s equality with men. (Less)
