På grund av revolutioner och användning av militärt våld i världen blir frågan om vem som ska
anses vara flykting tämligen aktuell. Ett centralt begrepp och rekvisit som måste uppfyllas för att en
person ska anses var flykting är att personen ska känna en välgrundad fruktan. I denna uppsats har
begreppet tagits under lupp och undersökts i detalj för att fastställa om begreppet välgrundad
fruktan i Sverige innehåller en subjektiv och en objektiv del. Eller om den endast innehåller en
objektiv del. Uppsatsen syftar även till att fastställa vad dessa bedömningar rent konkret innebär,
detta genom en undersökning av hur de beslutande myndigheterna avgör om välgrundad fruktan

anses vara flykting tämligen aktuell. Ett centralt begrepp och rekvisit som måste uppfyllas för att en
person ska anses var flykting är att personen ska känna en välgrundad fruktan. I denna uppsats har
begreppet tagits under lupp och undersökts i detalj för att fastställa om begreppet välgrundad
fruktan i Sverige innehåller en subjektiv och en objektiv del. Eller om den endast innehåller en
objektiv del. Uppsatsen syftar även till att fastställa vad dessa bedömningar rent konkret innebär,
detta genom en undersökning av hur de beslutande myndigheterna avgör om välgrundad fruktan
föreligger. Uppsatsen syftar slutligen till att kritiskt granska tolkningen av begreppet ”välgrundad
fruktan”, med tanke på dess internationella kontext.
Resultatet av denna undersökning är att tolkningen av begreppet välgrundad fruktan har lett till att
begreppet i Sverige innehåller såväl en objektiv som en subjektiv del, men den subjektiva delen är i
praxis inkorporerad i den objektiva bedömningen. Vidare visar den kritiska granskningen att
begreppet är tillfredsställande om konventionens ordalydelse och konventionens syfte beaktas.

The question: Who is to be considered a refugee? Becomes very up-to-date due to increasing
amount of revolutions and military violence in the world. A central part of the refugee concept is
that the person who is applying for refugee status fells a ”well founded fear”. In this essay the
phrase has been examined. The investigation has aimed to find out wether the Swedish
interpritation of the phrase consists of a subjective and an objective judgment. Or if the phrase only
consists of an objective judgment. This essay also aims to find out how these judgment are done by

The result of this essay is that the interpritation of the phrase in Sweden consists of an objective and
a subjective judgment, but the subjective part of the judgment is built-in to the objective part of the
judgment when the governing authority's make their decisions. The investigation also shows that the
Swedish interpretation of the phrase is competent in the light of the conventions purpose and the
wording in the convention. Therefore the Swedish interpretation of the phrase is competent in its
