Irreguljära migrantarbetare - dagens problem, morgondagens lösning?

Irreguljära migrantarbetare utgör en särskild, odefinierbar grupp, som arbetar och lever i periferin av samhället. I rädsla för att hela deras tillvaro ska rasera, gör de allt i sin makt för att gömma sig från statsmakten. På grund av sin lagstridiga vistelse i landet faller de utanför det traditionella arbetsrättsliga skyddet.
Internationella och regionala rättsliga regleringar är relevanta på grund av deras påverkan på nationell rätt. Som ett led i arbetet kommer uppsatsen studera hur den svenska rätten samspelar med den internationella kontexten kring de irreguljära migrantarbetarna.

Irreguljära migrantarbetare utgör en särskild, odefinierbar grupp, som arbetar och lever i periferin av samhället. I rädsla för att hela deras tillvaro ska rasera, gör de allt i sin makt för att gömma sig från statsmakten. På grund av sin lagstridiga vistelse i landet faller de utanför det traditionella arbetsrättsliga skyddet.
Internationella och regionala rättsliga regleringar är relevanta på grund av deras påverkan på nationell rätt. Som ett led i arbetet kommer uppsatsen studera hur den svenska rätten samspelar med den internationella kontexten kring de irreguljära migrantarbetarna.
Vi kommer att använda den traditionella rättsdogmatiska metoden, genom att studera befintliga rättskällor, granska dessa och till sist analysera rättsläget. Regleringar beträffande irreguljära migrantarbetare är av internationell, regional och nationell karaktär. Det finns exempelvis konventioner som berör odokumenterade arbetstagares principiella mänskliga rättigheter. Dessa har en stark normgivande funktion men är inte alltid rättsligt bindande. De regionala regleringarna har genom bland annat fördrag och direktiv, bidragit till flera bindande rättsliga principer för Sverige. Regleringar gällande irreguljära migrantarbetare är främst av migrationsrättslig karaktär men inverkar även på andra rättsfält.
En intressant aspekt är diskussionen om de konsekvenser som de irreguljära migrantarbetarna kan föranleda på arbetsmarknaden. Huruvida odokumenterade arbetstagare möjligen kan utgöra en god resurs på arbetsmarknaden i framtiden diskuteras. På så sätt nyanseras det aktuella rättsläget och ställer frågan om irreguljära migrantarbetare på sin spets. (Less)
Abstract
Irregular migrant workers constitute a special indefinable group, working and living in the periphery of society. In fear that their whole existence will demolish, they do everything in their power to hide from the government. Because of their illegal stay in the country, the traditional labor law protection does not apply. At any attempt of asserting their rights, they risk both dismissal and expulsion. The international and regional law is relevant because of their impact on national law and also because of specific regional bodies' regulations, such as directive (2009/52/EG). As a part of this thesis we will study how the Swedish law interacts with the international context, regarding the irregular migrant workers.

Irregular migrant workers constitute a special indefinable group, working and living in the periphery of society. Because of their illegal stay in the country, the traditional labor law protection does not apply. At any attempt of asserting their rights, they risk both dismissal and expulsion. The international and regional law is relevant because of their impact on national law and also because of specific regional bodies' regulations, such as directive (2009/52/EG). As a part of this thesis we will study how the Swedish law interacts with the international context, regarding the irregular migrant workers.
The thesis is based on the traditional legal dogmatic method, and by studying existing legal sources and analyzing them we hope to ascertain the current legal status regarding irregular migrant workers. Fundamental human rights regarding undocumented workers, are to be found in international legal sources, such as conventions. These have a strong normative function, but are not always legally binding. Regional regulations as treaties and directives, have contributed to several binding legal principles for Sweden. Regulations relating to irregular migrant workers are mainly characterized by migration law, but affect other legal fields as well.
The discussion, about irregular migrant workers impact on the labor market, is an interesting aspect. The paper aims to provide a perspective of the situation, by studying whether undocumented workers may be a good resource on the labor market in the future. Instead of considering them as a problem in society, they can be seen as an opportunity. Thus the current legal situation can be nuanced. (Less)
