Ett riskfyllt umgänge i barnets intresse? En studie av domstolens riskbedömning i vårdnadsmål

En vårdnadstvist hör ofta samman med föräldrars separation, vilken kan grunda sig i en konflikt föräldrarna emellan. Domstolens prövning kan även komma att påverka barnet i olika hänseenden. Det händer att en förälder hävdar att det finns en risk för barnet att vara med den andra föräldern. Det kan vara en anklagelse om att den andra föräldern allvarligt har misshandlat barnet eller föräldern, missbrukar något som anses skadligt, planerar att föra bort barnet eller lider av en psykisk sjukdom. Sådana omständigheter benämns som riskfaktorer, vilket innebär att de medför en risk för att barnet i framtiden kommer att utsättas för ett skadligt beteende. Sådana omständigheter benämns som riskfaktorer, vilket innebär att de medför en risk för att barnet i framtiden kommer att utsättas för ett skadligt beteende. Det är inte möjligt att i lagen definiera alla sådana omständigheter. Frågan om barnets kontakt med en förälder är förenad med en risk för barnet utgör en del av prövningen av barnets bästa enligt 6 kap. 2 a § andra stycket FB. Riskbedömningens huvudsakliga uppgift är att förutsäga vad en viss typ av miljö riskerar att utsätta barnet för.

Kärnan i riskbedömningen kan sägas spegla sig i avvägningen mellan olika intressen. Barn har en absolut rätt till att växa upp under förhållanden fria från våld, övergrepp och annan ogynnsam behandling. Samtidigt har även de flesta barn ett behov av att upprätthålla en nära och god kontakt med båda föräldrarna. Det senare behovet kan benämnas som barnets rätt till familjeliv. Europakonventionens artikel 8 garanterar såväl föräldrars som barns rätt till skydd för sitt familjeliv. En central frågeställning för uppsatsen är var gränsen mellan vikten av kontakt mellan barn och föräldrar och barnets behov av skydd går. För att domstolen ska begränsa kontakten mellan barn och förälder måste det finnas en konkret risk för att barnet i framtiden kommer att fara illa. Det innebär att domstolen måste fastställa ett konkret orsakssamband mellan det som är utrett om barnets situation idag och den möjliga framtida skadan. En del av riskbedömningen består i att göra en prognos om en framtida utveckling, vilket innebär att en risknivå inte kan sägas vara antingen sann eller falsk. Domstolen har således att företa en sannolikhetsbedömning.

Tillgången till relevant och tillräcklig information är av avgörande betydelse för att domstolen ska kunna göra en prognos som är så säker som möjligt. Ansvaret för att barnets situation blir tillbörligt utredd har lagts på domstolen. Kravet på en fullgod utredning uppfylls generellt sett genom att domstolen uppdrar åt socialnämnden att verkställa en vårdnadsutredning. Domstolen får genom vårdnadsutredningen den huvudsakliga kunskapen om det enskilda barnets behov. Risken för att barnet kan fara illa utgör en sådan omständighet som alltid ska utredas i enlighet med rättens utredningsansvar, om det finns en indikation på att barnets kontakt med en förälder kan skada barnet.

Uppsatsen tar även upp frågeställningen vad domstolens riskbedömning leder till. När domstolen kommer fram till att det finns en risk för att barnet kommer att fara illa bör risken väga tungt i helhetsbedömningen av barnets bästa. Riskbedömningen kan leda till att en förälder med våldsproblematik anses utgöra en risk i förhållande till frågan om vårdnad och därför inte ges del i denna. I ett sådant fall kan det sägas att risken har getts utslagsgivande betydelse. Inga andra intressen har således tagit över. Risken behöver dock inte alltid ges utslagsgivande betydelse för frågan om det ska äga rum umgänge överhuvudtaget. Det måste alltid bli beroende av en individuell prövning. En exponering av en risk kan anses som acceptabel vid beaktandet av skyddsfaktorer i barnets miljö. En slutsats är att barnets behov av en nära och god kontakt med båda föräldrarna är vägledande när domstolen har att avgöra det enskilda barnets bästa. Det enskilda barnets bästa ska dock vara avgörande för alla beslut om vårdnad, boende och umgänge och några andra intressen får inte gå före. Det är följaktligen barnet som har en rätt att få träffa sina föräldrar och det handlar inte om att tillgodose föräldrarnas intresse. Domstolen måste i detta hänseende vara realistisk och det kan ibland vara bäst för barnet att något umgänge inte alls äger rum, i det fall ett umgänge med en förälder är förenat med risk för barnet. A parent may claim there is a risk to the child when spending time with the other parent. Such an allegation may consist of child abuse, domestic violence, substance abuse, child abduction or mental ill health. The enumerated circumstances may be described as risk factors, thus such circumstances that contribute to the risk that the child in the future may fare badly. A parent may claim there is a risk to the child when spending time with the other parent. Such an allegation may consist of child abuse, domestic violence, substance abuse, child abduction or mental ill health. The enumerated circumstances may be described as risk factors, thus such circumstances that contribute to the risk that the child in the future may fare badly. It is not possible to define all risk situations legally. Within a legal proceeding concerning child custody the court is obliged to find a solution, which is in the best interest of the child, Parental Code, Chap. 6 Sect. 2 a. Within this solution the court needs to determine if a parent poses a risk of harm to the child. The fundamental task of the risk assessment is to predict the child’s developmental outcomes associated with alternative environmental circumstances.

The core of the court’s risk assessment may be said to reflect the balance betweeen different interests. Every child has an absolute right never to be subjected to violence, abuse or other degrading treatment from a parent. At the same time, in the great majority of cases, it is in the best interest of the child to maintain personal relations and direct contact with both parents on a regular basis. This latter need can be described as a child’s right to family life. Article 8 of the European Convention on Human Rights provides the right to respect for family life of the child and the parents. A central issue for the thesis is what degree of risk is required to intervene, i.e. when the child’s need for protection will take precedence of the child’s right to family life. A limitation in contact between a child and a parent requires there must be a real risk that the child in the future may fare badly. This means the court must identify a causal relationship between that which is established on the child’s situation today and the potential future damage. A part of the risk assessment is the court’s prediciton about the future, thus the risk level cannot be said to be either true or false. The risk assessment looks at the likelihood of future maltreatment due to family characteristics.

The court’s possibility to make a correct prognose is dependent on the courts’s access to relevant and sufficient information. In child custody cases, the court is responsible for collecting and ensuring the information which is needed to assess risk. This responsibility may be seen as fulfilled through the court’s instruction to the social welfare committee to execute an investigation of the child’s situation. The investigation allows the court to base its decision on each child’s needs. If there is an indication that the child may fare badly, the potential risk must be focused on as part of the investigation.

The thesis also concerns what the risk assessment undertaken by a civil court may lead to. When the court has come to the conclusion there is a risk
that the child in the future may fare badly, the risk is to be given great importance in determining the best interest of the child. The risk assessment may lead to that a parent associated with a risk concerning physical abuse will not be given part in the custody of the child. In such a case the risk is considered to be decisive in the custody legal proceeding. That means no other interests can be given greater importance. When the court has to rule on a question of access rights between a child and a parent the risk must not be given a decisive role. Whether a child who is separated from one parent has the right to maintain contact with the parent depends on the circumstances in each individual case. An exposure of a risk may be seen as acceptable due to sufficient protective factors existing to ensure the child’s safety and well-being. A conclusion is that a child’s need for a close contact with both parents remains as a guiding principle for the court in determining the best interest of the child. Nonetheless, it has to be borne in mind that it is the interest of the child and nothing else, that must hold the central place when the court has to rule on rights of custody, the child’s place of residence and rights of access. As follows, the child’s right to maintain a personal relation with a parent overshadows the parent’s right to aceess with its child. The court must, in this respect, apply a realistic approach. Thus, in some cases it is really in the best interest of the child not to maintain contact with the parent the child is separated from due to risk. (Less)
