- Parternas tillgång till bevis i skiljeförfarande är ofta avgörande för tvistens utgång. I synnerhet är anskaffningen av skriftlig bevisning essentiell då den av skiljenämnden generellt tillmäts ett högre bevisvärde än övriga bevismedel. Det huvudsakliga syftet med uppsatsen är att undersöka om parter i ett skiljeförfarande som äger rum i Sverige kan anskaffa erforderlig bevisning utan att tidsåtgången och kostnaden blir för stor. Om så ej finnes vara fallet syftar framställningen vidare till att föreslå effektiviseringsåtgärder utan att part eller tredje mans rättssäkerhet åsidosätts. I synnerhet är anskaffningen av skriftlig bevisning essentiell då den av skiljenämnden generellt tillmäts ett högre bevisvärde än övriga bevismedel. Det huvudsakliga syftet med uppsatsen är att undersöka om parter i ett skiljeförfarande som äger rum i Sverige kan anskaffa erforderlig bevisning utan att tidsåtgången och kostnaden blir för stor. Om så ej finnes vara fallet syftar framställningen vidare till att föreslå effektiviseringsåtgärder utan att part eller tredje mans rättssäkerhet åsidosätts. I nationella och internationella skiljeförfaranden har part två huvudsakliga möjligheter för att anskaffa skriftlig bevisning: genom editionsuppmaning av skiljenämnd eller editionsföreläggande av domstol. En editionsuppmaning beviljas av skiljenämnden enligt LSF och IBA-reglerna om den begärda handlingen identifieras, är relevant, innehas av motparten eller tredje man samt inte avser exempelvis sekretesskyddad information. Editionsuppmaningen är ett effektivt sätt för parterna att anskaffa skriftlig bevisning från motpart eller tredje man. Men i de fall en editionsuppmaning ej efterföljs måste part söka få ett editionsföreläggande till stånd av domstol. För att bevis ska anskaffas med tvång av domstol i skiljeförfaranden, krävs enligt 26§ LSF att skiljenämnden givit tillstånd därtill. Skiljenämndens tillstånd till sådan domstolsassistans lämnas om tvångsmedelsbehov finns, om handlingen kan identifieras, om den har bevisbetydelse samt innehas av motparten eller tredje man och inte laga hinder föreligger för edition. Med skiljenämndens tillstånd kan part vända sig till domstolen som meddelar ett editionsföreläggande om inga laga hinder föreligger. Editionsförelägganden av nationell domstol är kostsamma, fördröjer förfarandet och är inte verkställbara utomlands. Möjligheten för part att få till stånd ett editionsföreläggande av utländsk domstol är vidare mycket begränsad.
För att främja en snabb och billig anskaffning av erforderlig bevisning bör skiljenämnden påverka part till att följa editionsuppmaningar genom att beakta en vägran att lämna ut handlingarna vid kostnadsfördelningen av förfarandet. Skiljenämnden bör även hålla ett inledande samrådsmöte med parterna och där ta kontrollen över editionen genom att klargöra när och under vilka förutsättningar edition ska ske samt erinra om att obstruktionstaktik kostnadssanktioneras. Sammantaget kan en adekvat tillämpning av gällande rätt resultera i att skiljeförfarande blir en för parterna än mer attraktiv tvistlösningsform, där envar ges en rätt att utföra sin talan utan att så sker på bekostnad av effektiviteten. - The parties’ access to evidence in arbitration is of major importance to the outcome of almost every dispute. The taking of documentary evidence is of particularly importance because of the high evidential value it is given by the arbitrators. The main purpose of the essay is to determine if the parties to arbitration in Sweden can gather adequate evidence without having to spend too much time and money. If the parties cannot gather documentary evidence in an efficient way, the purpose of the essay is furthermore to consider measures to make the evidential gathering more efficient without limiting the party’s right to present its case. The parties have two main opportunities to gather documentary evidence in domestic and international arbitration; through an arbitral order for production of documents or through subpoenas issued by the court. According to the Arbitration Act and the IBA-rules, an arbitral order for production of documents requires that the sought documents are identified, relevant, in the possession of the opposing party and do not contain confidential information. A document production order is an efficient way for a party to obtain evidence from the opposing part or a third party. If a part or a third party refuses to voluntarily produce certain documents pursuant to another party’s request, subpoenas by the court are needed in order to obtain the documents. According to section 26 of the Arbitration act, the arbitrator’s permission is needed in order for the party to seek court assistance. Such permission to seek court assistance is given if the party shows that the evidence cannot be obtained without court assistance, if the documents are identified, relevant, in the possession of the opposing party or third party and if there are no legal obstacles. With the consent of the arbitral tribunal the court may grant the party’s request if the means of compulsion may be lawfully taken. Subpoenas by the court will delay and increase the costs of the arbitral proceeding. There are limited possibilities for a party to obtain an order to produce documents by a foreign court.
In order to enhance the efficiency in the taking of evidence, the arbitrators may take a failure to produce documents into account in its assignment of the cost of the arbitration. The arbitrators may furthermore organize an early consultation with the parties and clarify the time and the terms for production of documents and recall that obstruction tactics will be sanctioned with costs. By applying the current provisions in an adequate manner, arbitration can be more advantageous for the parties, although they achieve an opportunity to present their case without deprivation of their right to an efficient dispute resolution.
